1. Does the Northern Territory Government pay legal expenses for Ministers who threaten defamation proceedings, issue proceedings, or who are defendants to defamation proceedings; if so, what are the guidelines for assistance.

2. If the answer to question 1 is yes, how many actions or complaints have been funded and at what cost per action.

3. If actions referred to above are funded by the Government, what is the budget item that is the source of these funds.

Government Contracts

Mr EDE to MINISTER for ASIAN RELATIONS, TRADE and INDUSTRY

1. What was the total value of contracts, with individual values of more than $50,000.00, issued by Northern Territory Government Departments and agencies in the 1994-95 financial year.

2. How many of the contracts referred to in question 1 were awarded to Northern Territory-owned firms.

ANSWER

1. Data used for this threshold has only specifically been captured on a service-wide basis since 1 January 1995.

In this time the Procurement Review Board reviewed recommendations by Agencies for the award of tenders which totalled $56.7m.

2. Of this total, $4.5m involved interstate tenders, i.e. 8.7%.

Total procurement expenditure, as published in the NT Government Gazette (award of contracts/purchases/services valued at $5,000+) for financial year 1994/95 was $150.6m.

$15.8m (approx 10%) of this was expended outside of the Northern Territory.

1. Has the Northern Territory Government concluded a cost agreement with the plaintiff in respect of the legal action involving Finch v Bell.

3. How was the conflict of interest in relation to Mr Finch resolved with respect to the cost agreement concluded between himself and the Cabinet in which he is a Minister.

5. Is the cost agreement referred to in question 4 in the same terms as that concluded with Dennis Hart.

1. The Northern Territory Government authorised indemnity of the plaintiffs legal costs.

2. The Crowns inherent right to represent a Minister of the Crown.

3. Mr Finch was excluded from Cabinet deliberations on this matter.

4. No. Cabinet decisions are privileged.

5. No. Dennis Hart was not and is not a Minister of the Crown.

6. $14,902 and an amount of $18,214 in a related action of Finch v ABC.

1. Has the Northern Territory Government concluded a cost agreement with the plaintiff in respect of the legal action involving Hart v ABC and Wrenn.

2. Under which statutory provision does the Chief Minister purport to make payments under the cost agreement to Mr Hart.

3. Has the Northern Territory Government paid any monies on this agreement to date; if so, how much.

4. If the answer to question 3 is yes, to whom were these monies paid under the agreement.

5. If the answer to question 3 is yes, what services were purchased by the Northern Territory Government under that agreement.

6. Was Andrew Wrenn eligible for a cost agreement under any implemented policy; if not, why not.

ANSWER

1. Yes.

2. Section 21 of the Financial Administration and Audit Act entitled ex gratia.

3. Yes. The Northern Territory Government has paid $648,654.48 under this Agreement. It should be noted however that the Government has also recovered monies from Mr Hart and the ABC pursuant to an agreed settlement of the action, the terms of which are confidential.

4. In short, to persons providing legal services. This includes legal services provided by Ward Keller, Mildrens and Counsel.

5. Legal services were purchased by the Northern Territory Government under that Agreement.

6. Andrew Wrenn was eligible to request a cost agreement under section 21 of the Financial Administration and Audit Act, and Police General Order L1.

1. Was Mr Everingham involved in a cost agreement with the Northern Territory Government with respect to legal action Everingham v Toyne.

ANSWER

While it would be useful to know if the Honourable Member for Macdonnell inquired as to whether the plaintiff Mr Phillip Toynes costs were in any way funded by his previous employer the Pitjantjarra Council, I can advise that Mr Everingham received no funding from the NT Government, nor did he have any costs agreement with the NT Government with respect to his defence of the action.

Darwin Port Authority Charges

1. What was the average port charge per container (TEU) charged by the Darwin Port Authority for containers unloaded and loaded at Darwin in the following financial years:

(a) 1993-94; and
(b) 1994-95.

ANSWER

The port charges per container (TEU) charged by the Darwin Port Authority for containers loaded and unloaded in Darwin during the financial years 1993/94 and 1994/95 are as follows:

Rebates are however offered to new customers on the proviso that the ship visits are of a regular nature and payment is effected within 30 days. These rebates are 50% of the quoted charges and currently apply to three shipping services.

Stevedoring and towage services are provided by private companies within the port and the charges are negotiated between the companies and the shipping companies. The Port Authority is not privy to these details. Other charges such as berthage, pilotage, port dues reflect on the size of the vessel and these are applicable whether a vessel carries one container or a thousand.

Government Financial Assistance - Modular Medical Products

1. Has the Northern Territory Government provided financial assistance to Modular Medical Products; if so, what is the amount of that assistance since the inception of the company.

2. If the answer to question 1 is yes, in what years was the financial assistance given.

3. If the answer to question 1 is yes, for what purposes was the financial assistance used.

ANSWER

1. Yes. The total amount of financial assistance provided to Modular Medical Products Pty Ltd since the inception of the company is $600,000.00 (excluding the $3,071.70 grant provided under the Export Marketing Assistance Scheme referred to in written question No 76).

2. Financial Years 1988/89 $150,000; 1989/90 $400,000; 1990/91 $50,000. These amounts all appear in the Departments relative annual reports.

3. At the time of incorporation of the company the Government provided seed capital by way of purchase of 150,000 x $1 shares.

* During 1989/90 the company was provided with a loan of $400,000, on commercial terms, to cover working capital requirements.

* During 1990/91 the company was provided with a further loan of $50,000, on commercial terms, to met additional working capital requirements.

* Note: these two loans were subsequently converted to equity.

Government Contracts - Modular Medical Products

1. Has the Northern Territory Government awarded contracts or work to Modular Medical Products; if so, what is the value of those contracts since the inception of the company.

3. Has the Northern Territory Government awarded any work to Modular Medical Products without formal contracts; if so, how much work has been awarded.

ANSWER

1. Yes. Territory Health Services have period contracts with Modular Medical Products (trading as Territory Surgical Supplies) worth approximately $244,000 per annum.

2. Supply of X-Ray Film, Bacteriological Culture Media, Linen and Medical Sundries. Other Departments (Police, Primary Industry and Fisheries) have also sourced supplies through Territory Surgical Supplies to a lesser extent.

Modular Medical Products

1. Are arrangements in place whereby equity in Modular Medical Products convert to payments to the Northern Territory Government; if so, what are the details of any such arrangements.

ANSWER

1. Yes. By virtue of a deed of agreement dated 8 November 1991 the Governments equity holding in Modular Medical Products Pty Ltd is to be re-purchased on a quarterly instalment basis, commencing at a rate of $5,000 and increasing to $25,000 per quarter, over an extended period of time.

1. Did the Northern Territory Government provide a grant to Modular Medical Products of $3,071.70, under the Export Marketing Assistance Scheme, in the 1991-92 financial year; if so, what was the purpose of that grant.

ANSWER

Yes.

The grant was associated with the costs of finding export markets for wheelchairs. The markets targeted were the United Kingdom, New Zealand and South East Asia.

The assistance provided partially reimbursed the company for costs of:

1. (a) Yes. An exemption from customs duty and sales tax was requested for a traditional Indonesian sailing perahu, the Nusantara, commissioned by the Museum and Art Gallery of the Northern Territory and imported to Australia for display at the complex at Bullocky Point.

An exemption from duty was not granted.

(a) The Office of the Minister for Industries and Development; and

1. Yes. The letters were drawn up with the intention of informing local business people of the nature of the British Aerospace project.
