The Chief Minister told the 7.30 Report on 18 August that the liquidated damages period on Parliament House had been extended. Will the minister confirm that Tipperary Developments, the project manager for the State Square project, has written to the government claiming that no liquidated damages for late completion apply to either Tipperary Developments or to the head contractor, Multiplex? Will the minister also confirm that Tipperary Developments claims that liquidated damages for late completion have not applied since the middle of 1991?

ANSWER

Mr Speaker, I certainly cannot give an off-the-cuff answer in relation to a letter because I have not seen such a letter. I would not be surprised if a letter of that kind had been written because, under these circumstances, companies attempt at all times to minimise any exposure. I can assure honourable members that, if a situation arises where contractual obligations have not been complied with and there is an area where the government is entitled to certain remunerations, we will take steps to obtain that money. Those are the circumstances - end of story.

For the benefit of the member for Wanguri, who obviously is ignorant in these matters, it could end up being a matter for litigation. Under those circumstances, action would be taken.

Mr MANZIE: Regardless of who writes what, you silly little man, if remuneration is available because of certain actions taken by the contractor, the government will act.
