1. MEETING:
    The Assembly met at 10:00 h. The Speaker, the Honourable L M Braham, took the Chair.

2. PRAYERS.

3. LEAVE OF ABSENCE:
    The Leader of Government Business (Mr Coulter) moved - That leave of absence be granted to the Member for Karama (Mr Palmer) on account of Government Business interstate.

4. VISITORS:
    The Speaker (Mrs Braham) drew attention to the presence in the gallery of Year 7 students from Moil Primary School and their teacher, Mrs Judith Green.
    On behalf of Honourable Members, the Speaker extended a warm welcome to the visitors.

5. PETITION:
    The Member for Jingili (Mr Balch) presented a petition from 147 petitioners requesting the Assembly to declare the Mount Wells Road to Mount Harris Road as public road by common usage and that access not be denied by a locked gate across the road. (Paper 296)

7. FIRST SITTING OF THE LEGISLATIVE COUNCIL, 5OTH ANNIVERSARY - MOTION AGREED TO:
    The Chief Minister (Mr Stone), by leave, moved - That this Assembly:

    1. (a) notes that the 16th of February 1998 marked the 50th Anniversary of the First Meeting of the Legislative Council of the Northern Territory of Australia;
        (b) acknowledges that the first partly elected Council effectively marked the beginning of legislative institution specifically for the Northern Territory; and

        (c) expresses gratitude for the work of the Members of the Council, and subsequently the Legislative Assembly, in achieving a range of milestones in constitutional development including self-government to the extent that the Territory now stands on the threshold of Statehood and the achievement of the same measure of constitutional rights as other Australians; and
      2. that the Terms of this Resolution be printed in an appropriate form and signed by all Members of the Assembly and that copies of the Resolution be conveyed to the Presiding Officers of State, Territory and Commonwealth Parliaments and former Members of the Legislative Council and Legislative Assembly. (Paper 301)

8. THE ASIAN REGIONAL ECONOMIC UPHEAVAL, THE NORTHERN TERRITORY AND STRATEGIES FOR THE FUTURE - STATEMENT NOTED:
    The Chief Minister (Mr Stone) made a statement about the financial difficulties which have confronted various Asian economies since May 1997 and their impact on the Northern Territory. (Paper 307)
    Mr Stone moved - That the Assembly take note of the Statement.
    Debate ensued.

On behalf of Honourable Members, the Speaker extended a warm welcome to the distinguished visitors.

10. COURT SECURITY BILL 1998 (Serial 42):
    The Deputy Chief Minister (Mr Reed) at the request of and on behalf of the Chief Minister (Mr Stone) presented a Bill for an Act to provide for the security of Courts and for related purposes.

    Mr Reed moved - That the Bill be now read a second time.
    On the motion of the Member for Nhulunbuy (Mr Stirling) debate was adjourned.

11. MAGISTRATES AMENDMENT BILL 1998 (Serial 48):
    The Deputy Chief Minister (Mr Reed) at the request of and on behalf of the Chief Minister (Mr Stone) presented a Bill for an Act to amend the Magistrates Act.
    Bill read a first time.
    Mr Reed moved - That the Bill be now read a second time.
    On the motion of the Member for Nhulunbuy (Mr Stirling) debate was adjourned.

12. MINE MANAGEMENT AMENDMENT BILL 1998 (Serial 53):
    The Minister for Resource Development (Mr Poole) presented a Bill for an Act to amend the Mine Management Act.
    Bill read a first time.
    Mr Poole moved - That the Bill be now read a second time.
    On the motion of the Leader of the Opposition (Mrs Hickey) debate was adjourned.

13. EDUCATION AMENDMENT BILL 1998 (Serial 54):
    The Minister for Education and Training (Mr Adamson) presented a Bill for an Act to amend the Education Act.
    Bill read a first time.
    Mr Adamson moved - That the Bill be now read a second time.
    On the motion of the Leader of the Opposition (Mrs Hickey) debate was adjourned.

14. WATER SUPPLY AND SEWERAGE AMENDMENT BILL 1997 (Serial 18):
    The Order of the Day having been read for the resumption of the debate on the motion - That the Bill be now read a second time -
    Debate resumed.
    Question put and passed.
    Bill read a second time.
    Leave granted for a motion for the third reading of the Bill to be moved forthwith.
    On the motion of the Minister for Essential Services (Mr Poole) the Bill was read a third time and passed to be a proposed law.

15. MINING AMENDMENT BILL (No 2) 1997 (Serial 24):
    The Order of the Day having been read for the resumption of the debate on the motion -That the Bill be now read a second time -

    On the motion of Mr Poole the following amendment was agreed to -
    Omit all the words after "subsection" and insert in their stead "(1)(d) 'taking possession of and'".
    Clause, as amended, agreed to.
    Clauses 7 and 8, by leave, taken together and agreed to.
    Clause 9 read.
    On the motion of Mr Poole the following amendment was agreed to -
    Omit from proposed subsection (2) in paragraph (b) "until the mining tenement ceases" and insert in its stead "until the application is refused or the existing mining tenement or the mining tenement granted or renewed under the application ceases".
Clause, as amended, agreed to.
Remainder of the Bill, by leave, taken as a whole and agreed to.
Bill to be reported with amendments.
