    The Assembly met at 11:00 h. The Speaker, the Honourable L M Braham, took the Chair.

    The Speaker advised Honourable Members of the receipt of the following Message from His Honour the Administrator:

4. DISTINGUISHED VISITORS:
    The Speaker (Mrs Braham) drew attention to the presence in the Speaker’s Gallery of the Hon Franca Arena, MLC, Member for the Legislative Council, New South Wales; the Hon Bruce Scott, Federal Minister for Veterans’ Affairs, and Mrs Scott; and the Hon Nick Dondas, MP, Member for the Northern Territory.
    On behalf of Honourable Members, the Speaker extended a warm welcome to the distinguished visitors.
5. VISITORS:
    The Speaker (Mrs Braham) drew attention to the presence in the gallery of Year 7 students from Gray Primary School, and their teachers, Mrs Sue Trimble, Ms Margaret Couper and Mrs Donelle Dingo.
    On behalf of Honourable Members, the Speaker extended a warm welcome to the visitors.

6. PETITIONS:
    The Member for Stuart (Mr Toyne) presented a petition from 322 petitioners requesting that the decision to bulldoze the Old Alice Springs Prison be halted immediately, the Heritage Listing of the Old Alice Springs Prison be respected and any development of this area be a matter of open public process. (Paper 252)
    Petition read.
    The Member for Stuart (Mr Toyne) presented a petition from 41 citizens of the Northern Territory requesting that the Assembly reject the Heritage Conservation Amendment Bill 1997 as it is believed that the Bill will lead to the destruction of Northern Territory heritage and damage the future. (Paper 253)

7. GULF CRISIS - MOTION AGREED TO:
    The Chief Minister (Mr Stone), by leave, moved - That -

    (1) this Assembly expresses it full support for Australia’s involvement with the multinational forces in the Persian Gulf; and

    (2) the Speaker forward the Resolution to the Prime Minister forthwith. (Paper 254).

10. POWER AND WATER AUTHORITY - WANGURI/TIWI POWER DISRUPTION - MINISTERIAL STATEMENT - MOTION TO NOTE STATEMENT:
    The Minister for Essential Services (Mr Poole) made a statement regarding power outages in the Wanguri/Tiwi area. (Paper 261)
    Mr Poole moved - That the Assembly take note of the Statement.

    Proposed Censure of the Minister for Essential Services - Motion Negatived:
The Leader of the Opposition (Mrs Hickey) moved the following amendment -
        Omit all words after “that” and insert in their stead “this Assembly condemns the Minister for Essential Services for his incompetence in delivering a reliable supply of electricity to Territorians and censures him for his poor performance in this portfolio and in his responsibilities as Correctional Services Minister.”.(Paper 262)

    The Leader of Government Business (Mr Coulter) informed the Assembly that the Government, pursuant to Standing Order 95, accepted the amendment as a motion of censure.

11. FINANCIAL INSTITUTIONS (NT) AMENDMENT BILL 1998 (Serial 44); BUILDING SOCIETIES ACT REPEAL BILL 1998 (Serial 45); and NORTHERN TERRITORY TREASURY CORPORATION AMENDMENT BILL 1998 (Serial 46):
    Suspension of Standing Orders - Take three Bills together: The Chief Minister (Mr Stone) moved - That so much of Standing Orders be suspended as would prevent three Bills, namely the Financial Institutions (NT) Amendment Bill 1998 (Serial 44); the Building Societies Act Repeal Bill 1998 (Serial 45); and the Northern Territory Treasury Corporation Amendment Bill 1998 (Serial 46) -

    (a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings, the Committee's report stage, and the third readings of the Bills together; and

    (b) the consideration of the Bills separately in the Committee of the Whole.

12. WASTE MANAGEMENT AND POLLUTION CONTROL BILL 1998 (Serial 41); and WASTE MANAGEMENT AND POLLUTION CONTROL (CONSEQUENTIAL AMENDMENTS) BILL 1998 (Serial 43)

    Omit all words after “That” and insert in their stead “the Assembly declines to give the Bill a second reading as it is of the opinion the Minister has:

          (a) failed to consult properly about the Bill;

          (b) failed to respect the Territorians who have expressed concerns regarding the Bill; and

          (c) failed to allay the fears of Territorians that the enactment of the Bill will be used by the Minister to destroy the Territory’s heritage places.”. (Paper 263)

          "(2A) The Minister must not revoke a declaration under subsection (2)(a) or (b) except —
                (a) for the purpose of protecting the health or safety of persons; or
                (b) in an emergency.".

        On the motion of Mr Palmer the following amendments were accordingly put, taken together and agreed to, after debate -
        Insert after proposed section 39H(5) the following:
          "(5A) Where the Minister revokes a declaration under subsection (2)(a) or (b), the Minister must table in the Legislative Assembly his or her reasons for the revocation within 3 sitting days of the Assembly after the revocation.";

        Insert after "destroy," in proposed section 39J(1)(c) "demolish,";

        Insert after "destruction," in proposed section 39K(1)(c) "demolition,";
        Omit from proposed section 39K(4) "The Minister" and insert in its stead "Subject to subsection (4A), the Minister";
        Insert after proposed section 39K(4) the following:
          “(4A) The Minister or the Minister's delegate must not authorise the conduct of an activity under subsection (1), (2) or (3) unless the Minister or the Minister's delegate has referred the matter to the Council for comment and has considered the comments received in accordance with the referral.
          “(4B) Where the Minister or the Minister's delegate receives an application under section 39J(1) or (2), the Minister or the Minister's delegate must refer the matter to which the application relates to the Council within 7 days after receiving the application.
          “(4C) Where the Minister or the Minister's delegate refers a matter to the Council in pursuance of subsection (4A), the Council must provide its comments within —
                (a) 14 days after receiving the referral; or
                (b) if the Minister specifies a longer period — that period.
          “(4D) The Minister or the Minister's delegate must advise the Council of his or her decision in respect of a matter referred to the Council for comment in pursuance of subsection (4A) and the reasons for that decision."; and

        Insert after proposed section 39K the following:

          “39L. COUNCIL MAY DELEGATE PROVISION OF COMMENTS
                “(1) The Council may, by resolution, delegate to a specified person or to a person for the time being holding, acting in or performing the duties of a specified office, designation or position any of its powers in relation to providing comments for the purposes of section 39K(4A).
                “(2) A power delegated under subsection (1) is to be taken to have been exercised by the Council.
                “(3) A delegation under subsection (1) does not prevent the exercise of a power by the Council.”.

        Debate ensued.
