1. MEETING:
The Assembly met at 10.00 h. The Speaker, the Honourable L M Braham, took the Chair.

3. PETITIONS:
The Member for Jingili (Mr Balch) presented a petition from 478 petitioners requesting the Assembly conduct a comprehensive environmental assessment of the Rapid Creek Catchment. (Paper 753)

The Member for Stuart (Mr Toyne) presented a petition from 5451 petitioners requesting the Assembly retain Department of Education school based nurses in schools. (Paper 754)

The Minister for Primary Industry and Fisheries (Mr Palmer) made a statement relating to the development of the Aquaculture Industry in the Northern Territory. (Paper 759)
Mr Palmer moved – That the Assembly take note of the Statement.

9. CRIMINAL CODE AMENDMENT BILL (No. 3) 1998 (Serial 122):
The Attorney-General (Mr Stone), pursuant to notice, presented a Bill for an Act to amend the Criminal Code.

Mr Stone moved – That the Bill be now read a second time.
On the motion of the Leader of the Opposition (Mrs Hickey) debate was adjourned.

10. CRIMINAL CODE AMENDMENT BILL (No. 4) 1998 (Serial 123); and JUSTICES AMENDMENT BILL (No. 2) 1998 (Serial 127):
Suspension of Standing Orders - Take two Bills together:
The Attorney-General (Mr Stone) moved - That so much of Standing Orders be suspended as would prevent two Bills, namely the Criminal Code Amendment Bill (No. 4) 1998 (Serial 123) and the Justices Amendment Bill (No. 2) 1998 (Serial 127) -

(a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings, the Committee's report stage, and the third readings of the Bills together; and

(b) the consideration of the Bills separately in the Committee of the Whole.

Question - put and passed - there being an absolute majority of the whole number of Members present and no dissentient voice.
Mr Stone, pursuant to notice, presented a Bill for an Act to amend the Criminal Code and a Bill for an Act to amend the Justices Act.

Mr Stone moved – That the Bills be now read a second time.
On the motion of the Leader of the Opposition (Mrs Hickey) debate was adjourned.

12. PENALTIES BILL 1998 (Serial 124); INTERPRETATION AMENDMENT BILL 1998 (Serial 125); AND SENTENCING AMENDMENT BILL
(No. 2) 1998 (Serial 126):
Suspension of Standing Orders - Take three Bills together:
The Attorney-General (Mr Stone) moved - That so much of Standing Orders be suspended as would prevent three Bills, namely the Penalties Bill 1998 (Serial 124); Interpretation Amendment Bill 1998 (Serial 125); and Sentencing Amendment Bill (No. 2) 1998 (Serial 126) -

(a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings, the Committee's report stage, and the third readings of the Bills together; and

(b) the consideration of the Bills separately in the Committee of the Whole.

Question - put and passed - there being an absolute majority of the whole number of Members present and no dissentient voice.
Mr Stone, pursuant to notice, presented a Bill for an Act to provide for monetary penalties for offences to be expressed as penalty units; a Bill for an Act to amend the Interpretation Act; and a Bill for an Act to amend the Sentencing Act.

13. MINING AMENDMENT BILL (No. 3) 1998 (Serial 110):

On the motion of Mr Poole the following amendments were agreed to –
Omit the amendments to sections 101A(1) and 113(1);
Omit from the amendment to section 140S(3) "Section 140S(3)" and substitute "Section 140S(3)(a) and (b) and (3A)"; and
Omit the amendments to sections 163(1)(f), 163(2) and 163(3) and substitute the following:

'Section 163(1)(f) "at the office of the Secretary" "with the Department"

Section 163(2A) "at the office of the Secretary" "with the Department"

Section 163(3) "Secretary" "Secretary or the principal registrar"

Sections 166B(1) and 166C(1) "Minister" (second occurring) "Department"'.

The Speaker resumed the Chair; the Chairman (Mr Mitchell) reported that the Committee had considered the Bill and agreed to the same with amendments.
On the motion of the Minister for Resource Development (Mr Poole) the Bill was read a third time and passed to be a proposed law.

14. MERLIN PROJECT AGREEMENT RATIFICATION BILL 1998 (Serial 116):
The Order of the Day having been read for the resumption of the debate on the question – That the Bill be now read a second time –

Leave granted for a motion for the third reading of the Bill to be moved forthwith.
On the motion of the Minister for Resource Development (Mr Poole) the Bill was read a third time and passed to be a proposed law.
