- The Assembly met at 10:00 h., pursuant to adjournment. The Speaker, the Honourable T.R. McCarthy, took the Chair.

3. VISITORS:
- The Speaker (Mr McCarthy) drew the attention of Honourable Members to the presence in the gallery of Year 5, 6 and 7 students from The Essington School and their teacher, Ms Carolyn Lockie.
On behalf of Honourable Members, the Speaker extended a warm welcome to the visitors.
4. CONDOLENCE - COMMODORE ERIC EUGENE JOHNSTON, AO, AM (Mil), OBE - MOTION AGREED TO:
- The Speaker informed Honourable Members of the death on 26 February 1997, of Commodore Eric Eugene Johnston, AO, AM (Mil), OBE, Administrator of the Northern Territory from 1981 to 1989.
The Chief Minister (Mr Stone), by leave, moved - That this Assembly expresses it deep regret at the death of Eric Eugene Johnston, Administrator of the Northern Territory from 1981 to 1989, and places on record its appreciation of his long, meritorious and dedicated service to the Northern Territory, not only as Administrator, but also as a truly remarkable Territorian and tenders its profound sympathy to his wife Joan and his family (Paper 3108).

5. CONDOLENCE - DENIS JOSEPH BARRITT - MOTION AGREED TO:
- The Speaker informed Honourable Members of the death, on 14 February 1997, of Denis Joseph Barritt, former Magistrate of the Northern Territory.
- The Chief Minister (Mr Stone), by leave, moved - That this Assembly expresses its deep regret at the death of Denis Joseph Barritt, Magistrate of the Northern Territory from 1978 until 1991, and places on record its appreciation of his long and meritorious service to the Northern Territory, not only within the justice system, but also within the wider community and tenders its profound sympathy to his family (Paper 3109).

- The Leader of Government Business (Mr Coulter) advised Members that the Minister for Primary Industry and Fisheries (Mr Palmer) was absent from the Chamber on Government Business and that, in his absence, questions related to his portfolio responsibilities should be directed to the Minister for Mines and Energy (Mr Manzie).
- The Member for Barkly (Mrs Hickey) presented a petition from 387 petitioners requesting that the Northern Territory Government put overhead power lines under ground (Paper 3110).

- The Member for Stuart (Mr Toyne), pursuant to Standing Order 57, made a personal explanation regarding comments made by the Minister for Education and Training (Mr Finch) which he claimed reflected upon his professional record as a school principal.

14. GAS STRATEGY CONSULTANCY - PAPER TABLED - STATEMENT AND PAPER NOTED:
- The Minister for Mines and Energy (Mr Manzie) laid on the Table a paper entitled Phase 1 Report: Natural Gas Demand Forecasts for the Northern Territory, Arthur D Little International, Inc, dated 9 December 1996 (Paper 3115).
Mr Manzie made a statement relating to the Territory’s strategy for gas supply and demand in future years.
- Mr Manzie moved - That the Assembly take note of the Statement and Report.

Explanation of speech: The Member for Macdonnell (Mr Bell), pursuant to Standing Order 54, made an explanation of part of his speech which he claimed had been misunderstood during debate.

The Leader of the Opposition (Mrs Hickey) moved the following amendment -
Omit subclause (1) and insert in its stead the following:
- "(1) Where a medical practitioner, psychologist, psychiatrist or social worker who has provided professional services to a person -
- (a) reasonably believes that the person -
- (i) holds, or intends to apply for, a licence or a permit; or
- (ii) possesses or has under his or her control, or intends to possess, have under his or her control or use, a firearm; and
- (b) is of the opinion, on the grounds of the person's mental or physical condition or otherwise in the interests of public safety, that it would be unsafe for the person to possess, have under his or her control or use a firearm,
- the medical practitioner, psychologist, psychiatrist or social worker must, as soon as practicable, give written notice of his or her belief and opinion, and the material facts on which the belief and opinion is based, to the Commissioner.
- "(1A) A notice given under subsection (1) must specify the name and address of the person to whom it refers.".
Mr Stone moved the following amendment, by leave -
Omit from clause 101(1) the word “may” and insert in its stead “must”.

Clause 102 read.
On the motion of Mr Stone the following amendments were taken together, by leave, and agreed to after debate -
Omit from subclause (1)(b) "or the Domestic Violence Act,"; and
Omit from subclause (2) all words before "it may" and insert in their stead the following:
- "(2) Where a person is charged with an offence relating to a firearm or involving the use of a firearm and the court finds the person guilty of the offence".
Clause 102, as amended, agreed to.
Clauses 103 to 107 taken together, by leave, and agreed to.
On the motion of Mr Stone the following new clause was inserted in the Bill -
- "107A. COMMENCEMENT OF PROSECUTIONS
"A prosecution for an offence against this Act is to be commenced -
- (a) not later than 12 months after the commission of the offence; or
(b) not later than 12 months after the offence is discovered but, in any event, not later than 2 years after the commission of the offence.".
On the motion of Mr Stone the following amendment was agreed to -
Omit "27(3)" and insert in its stead "61".

Mrs Hickey moved - That the following new clause be added to the Bill -
"113. REVIEW
- "(1) The Minister is, not earlier than 2 years, but in any case within 3 years, after the commencement of this Act, to -
- (a) review the administration and operation of this Act for the purpose of -
- (i) ascertaining whether or not this Act adequately regulates the ownership and use of firearms within the Territory and promotes public safety; and
- (ii) making recommendations for improving the administration and operation of this Act; and
- (b) lay before the Legislative Assembly a report on the findings of the review.
- "(2) In conducting the review under subsection (1) the Minister is to consult with, and give consideration to the views of -
- (a) not less than 2 members of the Police Force nominated by the Commissioner;
- (b) the members of the Firearms Advisory Council; and
- (c) any other person who, in the opinion of the Minister, is able to contribute to the review.".
