1. MEETING:
    The Assembly met at 10.00 a.m., pursuant to resolution of the Assembly, dated Thursday 25 May 1995. The Speaker, the Honourable T.R. McCarthy, took the Chair.

2. PRAYERS.

3. FILMING IN THE CHAMBER:
    The Speaker advised Members that approval had been given for ABC-TV and Channel 8 to film in the Chamber today during the Swearing in of the Member for Fannie Bay. In addition, permission had been given for Mr Peter Torr to photograph the Chamber from the Galleries and the floor for the purposes of providing photographs for official records and for use in official Assembly publications.


4. RETURN TO WRIT - FANNIE BAY DIVISION:
    The Clerk produced and tabled the Writ for Election issued by the Honourable Keith John Austin Asche, AC QC, the Administrator of the Northern Territory of Australia, on 31 May 1995 for the election of one Member of the Legislative Assembly of the Northern Territory of Australia for the division of Fannie Bay to fill the vacancy caused by the resignation of Marshall Bruce Perron (Paper 1850).
    By the endorsement on the Writ, dated 20 June 1995, it was certified that Clare Majella Martin had been duly elected.
5. MEMBER SWORN - MS C. M. MARTIN:
    The Member for Fannie Bay, Ms Clare Majella Martin, was admitted to the Chamber, made and subscribed oaths of allegiance and of office, and was conducted to her place.

6. VISITORS:
    The Speaker (Mr McCarthy) drew the attention of Honourable Members to the presence in the gallery of Year 6/7 students from Malak Primary School and their teacher, Mr Jim Kensey.
      On behalf of Honourable Members, the Speaker extended a warm welcome to the visitors.

7. PRIVILEGE - ALLEGED MISLEADING OF THE ASSEMBLY BY MINISTER FOR EDUCATION AND TRAINING - SPEAKER’S DECISION NOT TO REFER MATTER TO COMMITTEE OF PRIVILEGES:
    The Speaker advised Members that he did not intend to refer to the Committee of Privileges the alleged matter of privilege raised by the Member for Wanguri (Mr Bailey) relating to alleged misleading of the Assembly by the Minister for Education and Training (Mr Finch) as the matter is currently under consideration by the Public Accounts Committee.

8. APPOINTMENT OF CHIEF MINISTER AND LEADER OF GOVERNMENT BUSINESS:
    The Chief Minister (Mr Stone) advised Honourable Members that the Administrator had appointed him as Chief Minister on 26 May 1995 and he would retain all his previous ministerial portfolios in addition to the portfolio of Chief Minister.
    Mr Stone also advised that the Treasurer (Mr Coulter) would be the Leader of Government Business until further notice.

9. NOTICES:
    The following notices were given:
      Mr Hatton: To present the Local Government Amendment Bill (No. 2) 1995 (Serial 90).
      Mr Reed: To present the Petroleum (Submerged Lands) Amendment Bill 1995 (Serial 88).
      Mr Finch: To present the Associations Incorporation Amendment Bill 1995 (Serial 91).
      Mr Ede: To move -
            (1) That the following matter be referred to the Standing Orders Committee for consideration and report - the most appropriate procedures for consideration of the allocations to Activities within Government Agencies in the annual Appropriation Bill with particular reference to the establishment of an Estimates Committee system; and
            (2) That, notwithstanding anything contained in the Standing Orders -
              (a) the Committee have power to send for persons, papers and records, to sit in public or in private session, notwithstanding any adjournment of the Assembly, to adjourn from place to place, and have leave to report from time to time its proceedings and the evidence taken and such interim recommendations as it may deem fit; and
              (b) the Committee be empowered to print from day to day such papers and evidence as may be ordered by it and, unless otherwise ordered by the Committee, a daily Hansard be published of such proceedings as take place in public.

      • Minute, Area/Regional Managers from Director Tenancy and Home Purchase Assistance re Rent Increases for non-rebates and rebatees, signed by Mike Green, dated 26 May 1995 (Paper 1842).

    Proposed Suspension of Standing Orders - Motion, Nuclear testing in Pacific by French Government: The Leader of the Opposition (Mr Ede) moved - That so much of Standing Orders be suspended as would prevent him from moving that -
      This house condemns the resumption of nuclear testing by France and further resolves that-
        (a) no cooperation, whether by way of fuel, services or supplies of any kind, will be provided to any French military vessel or aircraft, or vessel or aircraft under contract to the French military, by any Northern Territory Government instrumentality, unless the vessel or aircraft is engaged in a humanitarian purpose;
        (b) the Commonwealth, State and Territory Governments be urged to enact similar bans; and
        (c) the contents of the resolution be forwarded to the Commonwealth, State and Territory Governments as well as to the French Government.
      Mr Coulter moved - That the question be now put.

    Suspension of Standing Orders - Motion - Order for consideration of allocations to Activities in the Schedule of Appropriation Bill 1995-96 (serial 80) - Motion agreed to: The Leader of Government Business (Mr Coulter) moved - That so much of Standing Orders be suspended as would prevent the Committee considering the allocations to the Activities within the Schedule of the Appropriation Bill being dealt with in the order set out in the list circulated to Members.
    Debate ensued.
    Question - put and passed - there being an absolute majority of the whole number of Members present and no dissentient voice.
    The Assembly, according to Order, resolved itself into Committee of the Whole for the consideration of the Bill.

    The Leader of Government Business (Mr Coulter) moved - That pursuant to Standing Order 255 -
    (1) That, unless otherwise ordered, at 10.00 a.m. on 21 June 1995 the Assembly resolve itself again into Committee of the Whole for further consideration of the Appropriation Bill 1995-96 (Serial 80); and
    (2) That this sitting of the Assembly be suspended until 10.00 a.m., Wednesday 21 June 1995.
