1. MEETING:
    The Assembly met at 10.00 a.m., pursuant to resolution of the Assembly, dated Thursday 29 February 1996. The Speaker, the Honourable T.R. McCarthy, took the Chair.

2. PRAYERS.

3. FILMING IN THE CHAMBER:
    The Speaker advised Members that permission had been given to ABC Television and Channel 8 to film in the Chamber this morning for the purposes of updating file footage.

4. MESSAGE FROM THE ADMINISTRATOR:
    The Speaker advised Honourable Members that he had received the following Message from His Honour the Administrator -

    I, KEITH JOHN AUSTIN ASCHE, the Administrator of the Northern Territory of Australia, in pursuance of section 11 of the Northern Territory (Self-Government) Act 1978 of the Commonwealth, recommend to the Legislative Assembly a Bill for an Act to make interim provision for the issuing and expenditure of the public moneys of the Territory in respect of the financial year ending 30 June 1997.

5. PETITIONS:
    The Member for Nhulunbuy (Mr Stirling) presented a petition from 1037 petitioners requesting the Assembly enact a law for the purpose of dog control in Nhulunbuy in the absence of a Local Government Authority in that township (Paper 2350).
      Petition read.
    The Member for Victoria River (Mr Baldwin) presented a petition from 81 petitioners requesting the Assembly take reasonable action to increase the resources of the Police, strengthen the 2 kilometre law and introduce a law against public drunkenness (Paper 2351).

6. NOTICES:
    The following notices were given:
      Mr Bell: To present the Care of the Dying Consultation Bill 1996 (Serial 155).

      Mrs Hickey: To move - That -
              the Northern Territory put in place administrative arrangements to improve honesty and integrity in our Parliament and Government, and demonstrate a commitment to full accountability by the Territory Parliament, Ministers and Members in our constitutional development towards Statehood.
      Mr Bailey: To move - That this Assembly resolves:

            (1) to establish a suitable Estimates Committee system in the Northern Territory to improve the accountability of public expenditure in the Northern Territory similar to the open processes which are established in the Commonwealth and other States and Territories;

            (2) that the Standing Orders Committee enquire and report as a matter of urgency on the most appropriate method of operation taking due regard to practice in place in other Commonwealth, State and Territory Parliaments; and

            (3) that the Committee report back to the Assembly on or before 13 August 1996.

7. LEAVE OF ABSENCE:
    The Leader of the Opposition (Mrs Hickey) moved - That leave of absence for this period of sittings be granted to the Member for Arnhem (Mr Ah Kit), on account of Parliamentary business.

    The Leader of the Opposition (Mrs Hickey), by leave, moved - That membership of Legislative Assembly Committees be varied as follows -

11. SELECT COMMITTEE ON INTERACTIVE TELEVISION GAMING, REPORT - PAPER TABLED - PAPER PRINTED - MOTION TO NOTE PAPER:
    The Speaker laid on the Table the Report of the Select Committee on Interactive Television Gaming entitled Report on the Impact of Broadband Communication Services on the Northern Territory’s Racing and Gaming Industry, which was presented by the Chairman of the Select Committee on Interactive Television Gaming (Mr Baldwin), on 10 April 1996 (Paper 2353).
    The Speaker advised that directions had been given for the printing and circulation of the Report pursuant to the Resolution of the Assembly on 22 February 1996.
    Mr Baldwin moved - That the Assembly take note of the Report and sought leave to continue his remarks at a later hour.
    Ordered - That Mr Baldwin have leave to continue his remarks at a later hour - Debate adjourned.

12. TRAGEDY AT PORT ARTHUR - CONDOLENCE MOTION:
    The Chief Minister (Mr Stone) moved - That:
      1. this Assembly resolves to express -
        its shock and concern at the multiple shootings which took place at Port Arthur, Tasmania, on Sunday 28 April 1996;
        its condolences to the families, relatives and friends of the 35 people who lost their lives in the tragedy;
        its sympathy to the 19 people physically injured, and the hundreds of other survivors, mentally scarred by that day’s event at Port Arthur;
        its appreciation and thanks to all those who so ably assisted in dealing with the tragedy and its aftermath; and that

      2. this Assembly requests Mr Speaker to convey the terms of this Resolution to the people of Tasmania through the State Premier, the Hon Tony Rundle, MHA.

13. QUESTIONS:
    Questions were asked of Ministers.
    Point of Order: The Member for Stuart (Mr Ede) raised as a possible matter of privilege the alleged comments made by the Chief Minister which would tend to inhibit the Opposition in the performance of their duties as Members.
    The Speaker undertook to examine the Hansard report and advise Members of his decision at a later hour.
    Further questions were asked of Ministers.

14. PROPOSED CENSURE OF MINISTER FOR PUBLIC EMPLOYMENT - MOTION NEGATIVED:
    Suspension of Standing Orders - Move motion of Censure of Minister of Public Employment: The Member for Nhulunbuy (Mr Stirling) moved - That so much of Standing Orders be suspended as would prevent him moving a motion of censure of the Minister for Public Employment (Mr Finch).
    The Leader of Government Business (Mr Coulter) informed the Assembly that the Government, pursuant to Standing Order 95, accepted the motion as a censure motion.
    The Member for Nhulunbuy (Mr Stirling) thereupon moved - That this Assembly censures the Minister for Public Employment -
      1. for his refusal to negotiate a single enterprise agreement between the teachers of the Northern Territory and the Country Liberal Party Government; and
      2. for his actions in inflaming the dispute with teachers and continuing the disruption to the Territory’s education system.
    Extension of time: The Deputy Leader of the Opposition (Mr Bailey) moved that an extension of time be granted to the Member for Nhulunbuy (Mr Stirling).

15. AUSTRALASIAN POLICE MINISTERS’ COUNCIL, CANBERRA 1996 - MINISTERIAL STATEMENT - STATEMENT NOTED:
    The Chief Minister (Mr Stone) made Statement relating to the Special Meeting of the Australasian Police Ministers’ Council held in Canberra on 10 May 1996 (Paper 2371).
      Mr Stone moved - That the Assembly take note of the Statement.
      Debate ensued.
      The Leader of the Opposition (Mrs Hickey) moved the following amendment -
      Add at the end of the motion -
      “And that it:
      establish an enquiry under the chairmanship of a Supreme Court judge into the level of violence in the Northern Territory; and
      1. charge this enquiry with the responsibility of examining the causes of violence in the Northern Territory; and
      2. recommends solutions to this violence.”.
      Debate ensued.

16. REQUEST FOR REFERRAL TO COMMITTEE OF PRIVILEGES - ALLEGED CONTRAVENTION OF SECTION 21(3) OF THE NORTHERN TERRITORY (SELF-GOVERNMENT) ACT BY THE MEMBER FOR SANDERSON:
    The Member for Macdonnell (Mr Bell), pursuant to Standing Order 83, raised as a matter of privilege the alleged contravention of section 21(3) of the Northern Territory (Self-Government) Act by the Member for Sanderson and requested the Speaker to refer the matter to the Committee of Privileges.
    The Speaker advised that he would consider the matter and give a decision at the earliest opportunity.
17. ALLEGED MATTER OF PRIVILEGE, COMMENTS BY THE CHIEF MINISTER:
    The Speaker advised Members that he had considered the possible matter of privilege raised by the Member for Stuart (Mr Ede) relating to remarks made by the Chief Minister during Question Time this day and advised as follows:
      ‘I have had a chance to examine Hansard and can find no implied threat to Members in the words of the Chief Minister, and I do not believe that there was a point of order arising from that issue.’.
18. REQUEST FOR REFERRAL TO COMMITTEE OF PRIVILEGES - ALLEGED CONTRAVENTION OF THE LEGISLATIVE ASSEMBLY (REGISTER OF MEMBER’S INTERESTS) ACT 1982 BY THE FORMER MEMBER FOR CASUARINA - MATTER NOT REFERRED:
    The Speaker advised Members that he had considered the matter raised by the Member for Wanguri (Mr Bailey) during Question Time on Thursday 29 February 1996 and his request for referral of that matter to the Committee of Privileges.
      The Speaker addressed the Assembly as follows:
      ‘Honourable Members will recall that, after Question Time on Thursday 29 February 1996, the Member for Wanguri, Mr Bailey, raised as a matter of privilege, pursuant to Standing Order 83, the matter referred to in the motion of which he gave notice on Wednesday 28 February 1996 relating to the former Member for Casuarina, Mr Nick Dondas.
      I undertook to consider the matter and advise the Assembly of my decision at the earliest opportunity.
      Honourable Members will be aware that the subject of the matter raised was addressed in a question to me by the Member for Barkly (Mrs Hickey), on Tuesday 20 February 1996. The question referred to the 1993-94 return of the former Member for Casuarina, pursuant to section 5 of the Legislative Assembly (Register of Members’ Interests) Act.
      I subsequently sought from Mr Dondas clarification of the matter raised by the Member for Barkly and a written response from Mr Dondas was tabled and included in the daily Hansard on Thursday 22 February 1996.
      Honourable Members will be aware of the statement I made on 16 August 1995, when dealing with a matter raised as a matter of privilege, where I announced the criterion I would adhere to when arriving at a decision, pursuant to Standing Order 84. That criterion was:
      “the principle that the Assembly possesses power to adjudge and deal with contempts should be used only where it is necessary to provide reasonable protection for the Assembly, its Committees and Members against any improper acts which would substantially obstruct or interfere with them in the exercise of their authority or performance of their functions.”.
      Having considered the written response from the former Member for Casuarina and, taking into account the remedies available to the Assembly and the notice of motion given by the Member for Wanguri which will be before the House tomorrow, I advise that I have decided not to refer the complaint to the Committee of Privileges.’.

19. REQUEST FOR REFERRAL TO COMMITTEE OF PRIVILEGES - ALLEGED CONTRAVENTION OF THE LEGISLATIVE ASSEMBLY (REGISTER OF MEMBERS’ INTERESTS) ACT1982 BY THE MEMBER FOR SANDERSON-MATTER NOT REFERRED:
    The Speaker advised Members that he had considered the matter raised by the Member for Macdonnell (Mr Bell) during the Adjournment Debate on Thursday 29 February 1996 and his subsequent request for referral of that matter to the Committee of Privileges.
      The Speaker addressed the Assembly as follows:
      ‘Honourable Members will be aware that on Thursday 29 February 1996, during debate on the motion “That the Assembly do now adjourn”, the Member for Macdonnell (Mr Bell) raised as a matter of privilege an alleged contempt by the Member for Sanderson, pursuant to section 10 of the Legislative Assembly (Register of Members’ Interests) Act.
      At that time, I advised the Assembly that I would consider the matter and give a decision at the earliest opportunity.
      I advise Honourable Members that I received a written submission by the Member for Macdonnell on this matter and sought an explanation from the Member for Sanderson and have received legal advice.
      Having regard to the previous practice of this Assembly and taking into account the criterion which I undertook to adhere to on 16 August 1995, when considering such matters, I advise the Assembly that I have decided not to refer the complaint by the Member for Macdonnell to the Committee of Privileges.’.

20. MOTION OF DISSENT FROM SPEAKER’S RULING- MOTION NEGATIVED:
    The Deputy Leader of the Opposition (Mr Bailey), pursuant to Standing Order 82, moved dissent from the Speaker’s ruling not to refer the matter of the former Member for Casuarina’s pecuniary interest return pursuant to section 5 of the Legislative Assembly (Register of Member's Interests) Act.

21. SUPPLY BILL 1996 - 97 (Serial 150):
    The Treasurer (Mr Reed), pursuant to Standing Order 230, presented a Bill for an Act to make interim provision for the issuing and expending of the public moneys of the Territory in respect of the financial year ending 30 June 1997, the subject of Message No. 19 of His Honour the Administrator read earlier this day.
      Bill read a first time.
    Suspension of Standing Orders - Pass all Stages: The Treasurer (Mr Reed) moved - That so much of Standing Orders be suspended as would prevent the Supply Bill 1996 - 97 (Serial 150) passing through all stages at these sittings.
    Question - put and passed - there being an absolute majority of the whole number of Members present and no dissentient voice.

22.MOTION - REQUEST FOR REFERRAL TO COMMITTEE OF PRIVILEGES - ALLEGED CONTRAVENTION OF THE LEGISLATIVE ASSEMBLY (REGISTER OF MEMBERS’ INTERESTS) ACT1982 BY THE MEMBER FOR SANDERSON - MOTION NEGATIVED:
    The Member for Macdonnell (Mr Bell), pursuant to Standing Order 84, raised as a matter of privilege the alleged breach of the Legislative Assembly (Register of Members’ Interests) Act 1982, by the Member for Sanderson (Mr Manzie).
      Mr Bell, by leave, moved - That - Because:
      1. the Member for Sanderson commenced action against Nationwide News Pty Ltd, Don Kennedy and John Loizou by writ on 8 November 1990 in respect of publication in October 1990;
      2. at some time during or after October 1990, the Member for Sanderson concluded an agreement for the provision of legal services with Cridlands and with counsel instructed by them (“the Manzie/Cridlands legal services agreement”);
      3. the Member for Sanderson made a request to the Country Liberal Party Cabinet that his liability under the Manzie/Cridlands legal services agreement be paid out of public funds;
      4. the Country Liberal Party Cabinet determined to pay the costs of the Member for Sanderson under the Manzie/Cridlands legal services agreement and concluded with Cridlands an agreement to pay those costs (“the costs agreement”);
      5. under the costs agreement, the amount of $23,946.25 was paid by the Country Liberal Party Government to Cridlands and counsel instructed by them;
      6. the amount referred to in paragraph (5) above represented a substantial interest within the meaning of section 5(1)(e) of the Legislative Assembly (Register of Members’ Interests) Act 1982 (“the Act”) and a financial benefit within the meaning of section 5(1)(f)(i) of that Act;
      7. Manzie v Nationwide News Pty Ltdet al was settled on the basis of a confidential agreement between the parties (“the settlement agreement”);
      8. it is presumed that, under the settlement agreement, the Member for Sanderson received a substantial interest within the meaning of section 5(1)(e) of the Legislative Assembly (Register of Members’ Interests) Act 1982 and a financial benefit within the meaning of section 5(1)(f)(i) of that Act;
      9. the Member for Sanderson had a public duty within the meaning of section 5(1)(e) of the Legislative Assembly (Register of Members’ Interests) Act 1982 as a Member of the Legislative Assembly to expend public funds efficiently;
      10. there was a conflict of interest within the meaning of section 5(1)(e) of the Legislative Assembly (Register of Members’ Interests) Act 1982 between the substantial interests received by the Member for Sanderson and referred to in paragraphs 6 and 8 above and his public duty referred to in paragraph 9 above;
      11. in none of the returns of the Member for Sanderson pursuant to his statutory duty mandated by section 4 of the Legislative Assembly (Register of Members’ Interests) Act 1982, were the amounts referred to in paragraphs (5) and (8) above disclosed; and
      12. the wilful refusal of the Member for Sanderson to amend his return under section 7 of the Legislative Assembly (Register of Members’ Interests) Act 1982 between the time that this was drawn to his attention during the February sittings 1996 and this day; and
      this Assembly resolves that:
      1. the Member for Sanderson’s failure to declare the conflict of interest referred to in paragraph (10) above is a prima facie breach of section 10 of the Legislative Assembly (Register of Members’ Interests) Act 1982;
      2. the Member for Sanderson’s failure to disclose the financial benefits referred to in paragraphs (6) and (8) above is a further breach of section 10 of the Legislative Assembly (Register of Members’ Interests) Act 1982; and
      3. this matter should be referred to the Privileges Committee as a matter of urgency.

      Section 267 of the Criminal Code is repealed.
      “3B. AMENDMENT OF RIGHTS OF THE TERMINALLY ILL ACT
      “The Rights of the Terminally Ill Act is amended -
      (a) by omitting from section 13(1) all words after ‘patient’s life’ and substituting ‘shall be taken, for the purposes of section 34 of the Births, Deaths and Marriages Registration Act, to have been responsible for the patient’s medical care immediately before death.’; and
      (b) by omitting from section 14(1) ‘the death certificate under the Registration of Births, Deaths and Marriages Act’ and substituting ‘the notice given to the Registrar under section 34 of the Births, Deaths and Marriages Registration Act’.”.

    The Acting Speaker (Mr Adamson) resumed the Chair and the Chairman (Mr Setter) reported that the Committee had considered the Bills and agreed to the Births, Deaths and Marriages Registration Bill 1996 (Serial 146) without amendment; and the Births, Deaths and Marriages Registration (Consequential Amendments) Bill 1996 (Serial 147) with amendments; and the reports were adopted.
    On the motion of the Attorney-General (Mr Hatton) the Bills were read a third time and passed to be proposed laws.

28. SESSIONAL COMMITTEE ON THE USE AND ABUSE OF ALCOHOL BY THE COMMUNITY - INTERIM REPORT ON PUBLIC DRUNKENNESS IN CENTRAL AUSTRALIA - EXTENSION TO REPORTING TIME, MOTION AGREED TO:
    The Chairman of the Sessional Committee on the Use and Abuse of Alcohol by the Community (Mr Finch), by leave, made an interim report on its reference relating to Public Drunkenness in Central Australia.
    Mr Finch, by leave, moved - That the Committee be granted an extension of time to submit a final report on or before 23 May 1996.
