1. MEETING:
    The Assembly met at 10.00 a.m., pursuant to adjournment. The Speaker, the Honourable T.R. McCarthy, took the Chair.

2. PRAYERS.

3. VISITORS:
    The Speaker (Mr McCarthy) drew the attention of Honourable Members to the presence in the gallery of students from Year 7 from Stuart Park Primary School and their teacher Mr Paul Nyhuis.
      On behalf of Honourable Members, the Speaker extended a warm welcome to the visitors.

4. PETITIONS:
    The Member for Brennan (Mr Burke) presented a petition from 487 petitioners requesting the Assembly refer the proposed Bill, entitled Rights of the Terminally Ill, to a Select Committee in order that the Committee may consult with members of the Northern Territory community and report back to the Assembly (Paper 506).
    The Member for Palmerston (Mr Coulter) presented a petition from 22 petitioners requesting the Assembly refer the proposed Bill, entitled Rights of the Terminally Ill, to a Select Committee in order that the Committee may consult with members of the Northern Territory community and report back to the Assembly (Paper 507).
    The Member for Port Darwin (Mr Stone) presented a petition from 19 petitioners requesting the Assembly refer the proposed Bill, entitled Rights of the Terminally Ill, to a Select Committee in order that the Committee may consult with members of the Northern Territory community and report back to the Assembly (Paper 508).

5. LEAVE OF ABSENCE:
    The Leader of Government Business (Mr Stone) moved - That leave of absence be granted to the Minister for Lands, Housing and Local Government (Mr Hatton) for today on account of his absence interstate on Government Business.
      Question - put and passed.

6. QUESTIONS:
    Questions were asked of Ministers.
    Paper tabled: The Minister for Health and Community Services (Mr Reed) laid on the Table the following paper -
      • “Deaths from methadone and heroin”, Article in the Lancet, Vol 343, dated 16 April 1994 (Paper 433).

    Further questions were asked of Ministers.

    Paper tabled: The Minister for Sport and Recreation (Mr Poole) laid on the Table the following Paper -
      • Letter, Mr Ray Buckley, President, Northern Territory Football League Inc to Mr Robin Flannery, Chief Executive Officer, Office of Sports, Recreation and Ethnic Affairs, dated 20 December 1994 (Paper 434).

    Further questions were asked of Ministers.
    Suspension of Standing Orders - Proposed Censure of Minister for Health and Community Services re Health and Welfare Services - Motion Negatived: The Member for Macdonnell (Mr Bell) moved - That so much of Standing Orders be suspended as would prevent the following motion being moved -
      “That this Assembly censures the Minister for Health and Community Services for failing to uphold his responsibility to protect the health and welfare of Territorians, particularly Aboriginal Territorians, as demonstrated by a series of reports released in recent
      weeks.”.

    Question - put and passed - there being an absolute majority of the whole number of Members present and no dissentient voice.

    The Leader of Government Business (Mr Stone) informed the Assembly that the Government, pursuant to Standing Order 95, accepted the motion as a censure motion.

    The Member for Macdonnell (Mr Bell) thereupon moved -
      “That this Assembly censures the Minister for Health and Community Services for failing to uphold his responsibility to protect the health and welfare of Territorians, particularly Aboriginal Territorians, as demonstrated by a series of reports released in recent weeks.”.
      Debate ensued.
    Leave of Absence: The Leader of Government Business (Mr Stone) moved - That leave of absence be granted to the Minister for Health and Community Services (Mr Reed) for the remainder of this day sitting due to government business interstate.
    Question - put and passed.

7. POKER MACHINES IN COMMUNITY VENUES - REPORT OF SELECT COMMITTEE - PAPER TABLED - PAPER PRINTED - PAPER NOTED:
    The Committee Chairman (Mr Burke) laid on the Table the Select Committee Report on Effects of Poker Machines in Community Venues (Paper 435).
      Mr Burke moved - That the report be printed.
      Question - put and passed.
      Mr Burke moved - That the Assembly take note of the Paper.
      Debate ensued.

8. NIGHTCLUB TRADING HOURS - MINISTERIAL STATEMENT - STATEMENT NOTED:
    The Minister for Sport and Recreation (Mr Poole) made a Statement relating to recent developments in nightclub trading hours and associated issues in Darwin (Paper 436).
      Mr Poole moved - That the Assembly take note of the Statement.
      Debate ensued.
      Question - put and passed.

9. EAST ARM PORT - MINISTERIAL STATEMENT - STATEMENT NOTED:
    The Minister for Transport and Works (Mr Manzie) made a Statement relating to the progress of construction of additional port facilities for Darwin at East Arm (Paper 437).
      Mr Manzie moved - That the Assembly take note of the Statement.
      Debate ensued.
      Question - put and passed.

10. JUVENILE JUSTICE AMENDMENT BILL 1995 (Serial 68):
    The Minister for Correctional Services (Mr Poole), pursuant to notice, presented a Bill for an Act to amend the Juvenile Justice Act.
      Bill read a first time.
      Mr Poole moved - That the Bill be now read a second time.
    On the motion of the Deputy Leader of the Opposition (Mrs Hickey) debate was adjourned.

11. ROAD TRANSPORT CHARGES (NORTHERN TERRITORY) BILL 1995 (Serial 69); and ROAD TRANSPORT REFORM (VEHICLES AND TRAFFIC) (NORTHERN TERRITORY) BILL 1995 (Serial 70) and MOTOR VEHICLES AMENDMENT BILL 1995 (Serial 71):
    Suspension of Standing Orders - Take three Bills together: The Minister for Transport and Works (Mr Manzie) moved - That so much of Standing Orders be suspended as would prevent three Bills, namely the Road Transport Charges (Northern Territory) Bill 1995 (Serial 69); the Road Transport Reform (Vehicles and Traffic) (Northern Territory) Bill 1995 (Serial 70) ; and the Motor Vehicles Amendment Bill 1995 (Serial 71) -
      (a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings, the Committee's report stage, and the third readings of the Bills together; and

      (b) the consideration of the Bills separately in the Committee of the Whole.


    Question - put and passed - there being an absolute majority of the whole number of Members present and no dissentient voice.

    Mr Manzie, pursuant to notice, presented a Bill for an Act to apply certain laws of the Commonwealth, as envisaged by the agreements scheduled to the National Road Transport Commission Act 1991 of the Commonwealth, relating to road transport charges as laws of the Territory, and for other purposes; a Bill for an Act to apply certain laws of the Commonwealth relating to road transport, as envisaged by the agreements scheduled to the National Road Transport Commission Act 1991 of the Commonwealth, as laws of the Territory, and for other purposes; and a Bill for an Act to amend the Motor Vehicles Act.
    Bills read a first time.
      Mr Manzie moved - That the Bills be now read a second time.
      On the motion of the Member for Wanguri (Mr Bailey) debate was adjourned.

12. PROCUREMENT BILL 1994 (Serial 53):
    The order of the day having been read for the resumption of the debate on the question - That the Bill be now read a second time -
      Debate ensued.
      Question - put and passed.
      Bill read a second time.
    The Assembly, according to Order, resolved itself into Committee of the whole for the consideration of the Bill.

      Clauses 1 to 5, by leave, taken together and agreed to.
      Clause 6 read.
      The Leader of the Opposition (Mr Ede) moved the following amendment -
      Insert after clause 6 (2) the following:
        “ (3) The primary function of the Procurement Review Board is to examine the practices and procedures adopted in the procurement of supplies by and on behalf of the Territory and Agencies to determine whether or not the practices and procedures comply with this Act.”.
      Debate ensued.
      Mr Ede, by leave, withdrew the amendment.
      Clause 6 agreed to.
      Mr Ede moved the following amendment -
      Insert after clause 6 the following:
        “6A. REPORT ON PROCUREMENT REVIEW BOARDS
        “ (1) The Minister shall, each year in respect of the year that ended on 30 June immediately preceding, prepare and present to the Legislative Assembly a report on the performance of the functions of each Procurement Review Board in existence during that year.
        “ (2) The Minister shall cause the report prepared under subsection (1) to be laid before the Legislative Assembly within 6 sitting days after 30 June in each year.”.
      New clause negatived, after debate.
      Clauses 7 and 8, by leave, taken together and agreed to.

      Clause 9 read.
      Mr Ede moved the following amendment -

      Insert after clause 9 (2) the following:
        “ (3) The Minister shall cause each certificate of exemption issued under subsection (1) to be laid before the Legislative Assembly within 6 sitting days after the date the Minister issued the certificate of exemption.”.
      Amendment negatived, after debate.
      Clause 9 agreed to.
      Remainder of the Bill, by leave, taken as a whole and agreed to.
      Bill to be reported without amendment.

    The Speaker (Mr McCarthy) resumed the Chair; the Chairman (Mr Setter) reported accordingly; and the report was adopted.
    On the motion of the Minister for Industries and Development (Mr Stone) the Bill was read a third time and passed to be proposed law.

13. ADJOURNMENT:
    The Minister for Primary Industry and Fisheries (Mr Palmer) moved - That the Assembly do now adjourn.
      Debate ensued.

      And the Assembly adjourned at 8.35 p.m. until Tuesday 28 February 1995 at 10.00 a.m.
