Minutes of Proceedings - 2006-08-31

1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable J. L. Aagaard, took the Chair.

2. PRAYERS.
    3. STATEMENT BY SPEAKER - SITTINGS PROGRAM 2007:
        The Speaker laid on the Table the schedule of sitting days for 2007 (Paper 623).
        Visitors: The Speaker advised Members of the presence in the galleries of students from FU-JEN Catholic University, Taiwan accompanied by Mr Terry Pailthorpe.
        On behalf of all Members the Speaker extended a warm welcome to the visitors.
    4. MINISTERIAL REPORTS:
        McArthur River Mining Company: The Minister for Mines (Mr Vatskalis) reported on his requirements to approve the McArthur River Mining operation expansion to an open cut mine.
        Ms Carney responded.
        Mr Wood responded.
        Mr Vatskalis responded.

        Arafura Games 2007: The Minister Sport and Recreation (Ms Lawrie) reported on her overseas visit to Malaysia and Vietnam to promote the Arafura Games 2007.
        Mr Mills responded.
        Ms Lawrie responded.

        Territory Housing Tenancies: The Minister for Housing (Mr McAdam) reported on the management of anti-social behaviour of public housing tenants.
        Dr Lim responded.

        Mining Roadshow July 2006: The Minister for Mines (Mr Vatskalis) reported on his attendance at a the Mining Industry Roadshow.
        Ms Carney responded.

    5. MEDICAL SERVICES AMENDMENT BILL 2006 (Serial 70) and CRIMINAL REFORM AMENDMENT BILL (No. 2) 2006 (Serial 71):
        The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act amend the Medical Services Act and a Bill for an to amend the Criminal Code and for related purposes.
        Bills read a first time.
        Dr Toyne moved - That the Bills be now read a second time.
        Paper tabled: Dr Toyne laid on the Table the following Paper -
    Explanatory Statement, Criminal Reform Amendment Bill (No. 2) 2006 (Serial 71) and Medical Services Reform Bill 2006 (Serial 70) (Paper 624).

        On the motion of the Member for Araluen (Ms Carney) debate was adjourned.
    6. ORDER OF BUSINESS:
        The Leader of Government Business (Mr Henderson) moved - That Government Business, Order of the Day No. 1 relating to the Carers Recognition Bill 2006 be called on forthwith.

            "(b) a person who has a chronic illness, including a mental illness as defined in the Mental Health and Related Services Act; or".

        Clause 5, as amended, agreed to, after debate.
        Clause 6 read.
        Debate ensued.

        Remainder of the Bill, by leave, taken as a whole and agreed to.
        Bill to be reported with an amendment.

        Answer to question: The Minister for Communications (Dr Burns) provided additional information in response to a question asked earlier this day relating to Seaphone services for Maritime Cyclone and Weather Warning System.

        Answer to question: The Minister for Employment, Education and Training (Mr Stirling) provided further information relating to a question asked earlier this day relating to Casuarina Secondary College location of alternative class rooms asked by the Member for Blain (Mr Mills).
    9. SUSPENSION OF STANDING ORDERS - PASS BILL THROUGH ALL STAGES - LIQUOR AMENDMENT BILL 2006 (Serial 63) - MOTION AGREED TO:
        The Minister for Racing, Gaming and Licensing (Mr Stirling), pursuant to notice, moved - That so much of Standing Orders be suspended as would prevent the Liquor Amendment Bill 2006 (Serial 63) passing through all stages at this sittings.
        Debate ensued.

    10. WATER EFFICIENCY LABELLING AND STANDARDS BILL 2006 (Serial 59):
        The Order of the Day having been read for the resumption of debate on the question - That the Bill be now read a second time -

        Leave granted for a motion for the third reading of the Bill to be moved forthwith.

    11. LIQUOR AMENDMENT BILL 2006 (Serial 63):
        The Order of the Day having been read for the resumption of debate on the question - That the Bill be now read a second time -
        Debate resumed.
        Extension of time: On the motion of the Minister for Family and Community Services (Ms Lawrie) the Minister for Racing, Gaming and Licensing (Mr Stirling) was granted an extension of time, pursuant to Standing Order 77.

        Debate continued.

        The Assembly resolved itself into Committee of the Whole for consideration of the Bill.

        On the motion of the Minister for Racing, Gaming and Licensing (Mr Stirling) the following amendment was agreed to, after debate.
        In proposed section 86D, after proposed subsection (c)(iv), insert -
            "(v) anyone else whom the Commission considers to have an interest in the area;".

        Clause 16, as amended, agreed to.
        Clauses, 17 to 19, by leave, taken together and agreed to.
        Clause 20 read.
        On the motion of Mr Stirling the following amendment was agreed to, after debate.
        Omit proposed section 89A(1) and insert in its stead -
            "(1) The Commission may grant a permit for a public restricted area to an individual or body (whether incorporated or not).".

        Clause 20, as amended, agreed to.
        Remainder of the Bill, by leave, taken as a whole and agreed to.
        Bill to be reported with amendments.

        On the motion of the Minister Racing, Gaming and Licensing (Mr Stirling) the Bill was read a third time and passed to be a proposed law.
    12. TERRITORY COMMUNICATIONS NEEDS - MINISTERIAL STATEMENT - MOTION TO NOTE STATEMENT:
        The Minister for Communications (Dr Burns) made a statement relating to recent activities and achievements within the Territory's telecommunications sector.
        Dr Burns moved - That the Assembly take note of the Statement.
        Debate ensued.
        On the motion of the Chief Minister (Ms Martin) debate was adjourned.
    13. NEXT MEETING:
        The Chief Minister (Ms Martin) moved - That the Assembly at its rising adjourn until Tuesday 10 October 2006 at 10am or such other time and/or date as may be set by the Speaker, pursuant to Sessional Order.
    14. ADJOURNMENT:
        The Chief Minister (Ms Martin) moved - That the Assembly do now adjourn.
