Minutes of Proceedings - 2005-10-13

1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable J. L. Aagaard, took the Chair.

2. PRAYERS.
      Visitors: The Speaker advised Members of the presence in the Speaker's Gallery of international visitors:
      Ms Jacynthe Cote - President and Chief Executive Officer Alcan Bauxite and Alumina, Mr Richard Yank - President Bauxite and Alumina Pacific Operations, Mr Doug Parish - Managing Director, Alcan Gove, Mr David Sutherland - Director Projects and Technology, Alcan south Pacific, Ms Sylvain Rouleau - Vice President, HR, Communications and Government Affairs, Mr Klaus Helms - General Manager Community Affairs, Alcan Gove.
      On behalf of all Members the Speaker extended a warm welcome to the visitors.

3. MINISTERIAL REPORTS:
      Skilled Worker Campaign: The Minister for Employment, Education and Training (Mr Stirling) reported on the Territory's skilled worker recruitment campaign.
      Ms Carney responded thereto.
      Ms Martin responded accordingly.

      Humanitarian Placements in the Territory: The Minister for Multicultural Affairs (Mr Vatskalis) reported on the government proposal to humanitarian settlement in the Northern Territory.
      Mr Mills responded thereto.
      Mrs Braham responded thereto.
      Mr Vatskalis responded accordingly.

      Crusty Demons: The Minister for Sport and Recreation (Ms Lawrie) reported on the arrival of the Crusty Demons motorcycle display team and event to be held at Marrara Oval.
      Mr Mills responded thereto.
      Ms Lawrie to responded accordingly.

      Ministerial reports noted, pursuant to Sessional Order.

4. REMUNERATION TRIBUNAL DETERMINATION NO.1 OF 2005, MAGISTRATES - DISALLOWANCE OF PART - MOTION AGREED TO:
      The Chief Minister (Ms Martin), pursuant to notice, moved - That this Assembly disapprove so much of Clause 3.5 of the Remuneration Tribunal Determination No.1 of 2005 in respect of Magistrates' Salary, Allowances and Other Benefits as it relates to -
- the daily rate of travelling allowance set out in Table 2 so far as it relates to Brisbane and Perth; and
- the rate for lunch set out in Table 3 so far as it relates to places other than capital cities.

      Debate ensued.

5. HOUSING AMENDMENT BILL (No. 2) 2005 (Serial 23):
      The Minister for Housing (Mr McAdam), pursuant to notice, presented a Bill for an Act to amend the Housing Act and repeal the Housing Loans Act, Housing (Concessional Loans) Regulations and Housing Loans Regulations.
      Bill read a first time.
      Mr McAdam moved - That the Bill be now read a second time.
      Debate ensued.
      Paper tabled: Mr McAdam laid on the Table the following Paper -
Explanatory Statement, Housing Amendment Bill (No. 2) 2005 (Serial 23) (Paper 231).

6. LEGISLATION REPEAL BILL 2005 (Serial 18):
      The Order of the Day having been read for the resumption of debate on the question - That the Bill be now read a second time -

      On the motion of the Minister for Justice and Attorney-General (Dr Toyne) the Bill was read a third time and passed to be a proposed law.

7. ABORIGINAL INTERPRETER SERVICE - MINISTERIAL STATEMENT - MOTION TO NOTE STATEMENT:
      The Minister for Local Government (Mr McAdam) made a statement relating to the Northern Territory Aboriginal Interpreter Services.
      Mr McAdam moved - That the Assembly take note of the Statement.

      Media Reporting - Statement by Speaker: The Speaker advised Members of the granting of permission for the Northern Territory News to take photographs and for ABC Radio News to record the speech of the Member for Macdonnell (Ms Alison Anderson) relating to her contribution to the Ministerial Statement on the Aboriginal Interpreter Service.

10. PROPOSED COMMONWEALTH LEGISLATION TO IMPOSE A RADIOACTIVE WASTE FACILITY ON THE NORTHERN TERRITORY - MOTION AGREED TO:
      Leave to move motion - Leave denied: The Chief Minister (Ms Martin) sought leave to move a motion relating to proposed Commonwealth legislation to impose a radioactive waste facility on the Northern Territory.
      A dissentient voice being raised - leave denied.

      Suspension of Standing orders - Move motion forthwith: The Chief Minister (Ms Martin) moved - That so much of Standing Orders be suspended as would prevent me moving a motion relating to proposed Commonwealth legislation to impose a radioactive waste facility on the Northern Territory, forthwith.
      Debate ensued.

      Recording and Rebroadcast of Debate: The Chief Minister (Ms Martin) sought and obtained from the Speaker her authorisation for the recording and rebroadcast of this debate by media representatives in accordance with Parliamentary Broadcast Guidelines.
      The Chief Minister (Ms Martin) thereupon moved - That,

      This Assembly:

      (1) Condemns

          the Howard government’s outrageous proposed legislation which overrides the rights of Territorians in pursuit of its plan to impose a radioactive waste storage facility in the Northern Territory.
      (2) Notes that the proposed legislation:
          (a) removes the rights of Territorians and their government to oppose the radioactive waste storage facility or to appeal decisions of any kind related to it;

          (b) overrides important environmental and heritage protection legislation; and

          (c) blocks any Territory endeavours to suitably scrutinise, review or regulate the Howard government’s plans.
      (3) Supports the Northern Territory government’s stand against the Howard government’s outrageous legislation.
        (4) Calls upon
            the Northern Territory’s representatives in the Commonwealth parliament to stand up for the rights of Territorians and vote against this outrageous legislation; and

        (5) Calls upon
            the Commonwealth parliament to reject this legislation as an outrageous attack on the rights of Territorians who because they live in a Territory do not have the constitutional rights of other Australians; and
        (6) The Speaker forward the terms of this motion together with a copy of the Hansard debate of members speeches to the Speaker of the House of Representatives and the President of the Senate.

        The Leader of the Opposition (Ms Carney) moved the following amendment -
        Omit all words after "That" and insert in its stead -
        This Assembly:

            (1) Condemns

                the Howard government’s proposed legislation which overrides the rights of Territorians in pursuit of its plan to impose a radioactive waste storage facility in the Northern Territory.
            (2) Notes that the proposed legislation:
                (a) removes the rights of Territorians and their government to oppose the radioactive waste storage facility or to appeal decisions of any kind related to it;

                (b) overrides important environmental and heritage protection legislation; and

                (c) blocks any Territory endeavours to suitably scrutinise, review or regulate the Howard government’s plans.
            (3) Supports the Northern Territory government’s stand against the Howard government’s legislation.
              (4) Calls upon
                  the Northern Territory’s representatives in the Commonwealth parliament to stand up for the rights of Territorians; and

              (5) Calls upon
                  the Commonwealth parliament to reject this legislation as an attack on the rights of Territorians who because they live in a Territory do not have the constitutional rights of other Australians; and
              (6) The Speaker forward the terms of this motion together with a copy of the Hansard debate of members speeches to the Speaker of the House of Representatives and the President of the Senate.

      12. BUILDING HEALTHIER COMMUNITIES - MINISTERIAL STATEMENT - MOTION TO NOTE STATEMENT:
          The Minister for Health (Dr Toyne) made a statement relating to the priorities in health and community services to build healthier communities.
          Dr Toyne moved - That the Assembly take note of the Statement.
