Minutes of Proceedings - 2005-11-29

1. MEETING:
      The Assembly met at 10am, pursuant to resolution of the Assembly, dated Thursday 20 October 2005. The Speaker, the Honourable J. L. Aagaard, took the Chair.

2. PRAYERS.

3. DISTINGUISHED VISITORS:
      The Speaker advised Members of the presence in the Speaker's Gallery of family members of Mr Lee, Mr Jack Ah Kit and members of the Jawoyn nation to witness the motion of condolence for Mr Lee in the Assembly today.
      On behalf of all Members the Speaker extended a warm welcome to the distinguished visitors.

4. VISITORS:
      The Speaker advised Members of the presence in the public galleries of Year 3 to Year 7 students from Wagaman Primary School Leadership Program and Year 10 Pathways Indigenous Students from Kormilda College.
      On behalf of all Members the Speaker extended a warm welcome to the visitors.

5. PETITIONS:
      Petition responses: The Clerk, pursuant to Standing Order 100A, presented responses to petitions No. 1 - Protection of Daly River; No. 4 - Adelaide River Museum pedestrian crossing; No. 5 - Slip lane entrance to the Humpty Doo and Rural Golf Club; and advised Members that the terms of the petitions would be incorporated in the Hansard record (Paper 291).
6. CONDOLENCE - Mr LEE - MOTION AGREED TO:
      The Chief Minister (Ms Martin), by leave, moved - That this Assembly:
        (a) express its deep regret at the death of Mr Lee, a proud Territorian, who throughout his life represented the Jawoyn nation and fought for the rights of his people; and

        (b) tender its profound sympathy to his family.

      Debate ensued.

      As a mark of respect Members stood in their places for one minute, in silence.

7. MINISTERIAL REPORTS:
      Economic Summit 2005: The Minister for Business and Economic Development (Mr Henderson) reported on the conduct of the second Economic Summit which has developed a roadmap for the next 10 years for the Territory's Development.
      Mr Mills responded.
      Mr Henderson responded.

      Investment Opportunities visit to Singapore: The Treasurer (Mr Stirling) reported on his visit to Singapore to meet with leading financial institutions and investors to demonstrate opportunities in Territory development.
      Mr Mills responded.
      Mr Stirling responded.

      Jabiru Town Development Authority: The Minister for Local Government (Mr McAdam) reported on matters associated with the dissolution of the Jabiru Town Council operations by the Jabiru Town Development Authority.
      Dr Lim responded.
      Mr Wood responded.
      Mr McAdam responded.

      Ministerial Reports noted, pursuant to Sessional Order.

11. NOTICES:
      The following notices were given -

      Dr Lim: To present the Unit Titles Amendment Bill 2005 (Serial 31).

      Mr Mills: To move - That,
              This Assembly calls on the Minister for Education to:

              (a) apologise to the families of Palmerston for breaching an election promise that has resulted in unacceptable overcrowding in the city’s schools;

              (b) apologise to the families of children supported by the Irrkerlantye Learning Centre for closing their school because of your government’s economic mismanagement; and

              (c) apologise to Territory teachers for paying lip service to rising concerns about stress and violence in the workplace.
      Mrs Braham: To move - That as a mater of urgency:
              (a) the decision by the Minister for Education, Employment and Training to close the Irrkerlantye learning centre, be reversed;

              (b) the Minister release the report upon which he made this decision;

              (c) a full review and evaluation be undertaken to assess the social, emotional and educational achievements of the centre; and

              (d) the outcome of the review be used in consultation with the staff and community members to identify future educational strategies.
      Ms Carney: To move - That this Assembly:
              (a) notes the threats presented to the Territory economy by the declining GST revenues;

              (b) calls on this Government to detail what election promises it will not keep to Territorians as a result of its economic mismanagement; and

              (c) calls on this Government to tell Territorians which taxes it will have to raise or introduce because of its economic mismanagement.
      Mr Wood: To move - That, -
              The Minister amend the Jabiru Town Development Authority Act removing the option of ministerial appointments as in 25C(1)(b) and 25C(2)(b) of the Act so that -

              (a) the council members only be members elected by the people of Jabiru;

              (b) the existing council then has its authority reinstated immediately to restore democracy for the citizens of Jabiru; and

              (c) the government is able to set up a process which removes the need for a Jabiru Town Development Authority and replace it with a fully elected local government under the Local Government Act which can be elected at the next due election date.

      The Member for Araluen (Ms Carney) moved a motion to suspend Standing Orders to censure the Treasurer, Chief Minister and Government relating to Territory finances -

      The Leader of Government Business (Mr Henderson) informed the Assembly that the government accepted the motion as a censure motion, pursuant to Standing Order 95.

      The Leader of Government Business (Mr Henderson) asked that further questions be placed on the Written Question Paper.
13. CENSURE OF TREASURER, CHIEF MINISTER AND GOVERNMENT - TERRITORY'S FINANCES AND ECONOMY - MOTION NEGATIVED:
      The Leader of the Opposition (Ms Carney) thereupon moved - That the Assembly censure the Treasurer, Chief Minister and Government for:
    lying to the elected Members of this Assembly about the state of the Northern Territory's finances;
      lying to the people of the Northern Territory prior to the last election about the state of the Northern Territory's finances; and
        fraudulently misrepresenting to Territorians the true state of the Territory economy.

          Debate ensued.

          The Chief Minister (Ms Martin) laid on the Table the Report of the Remuneration Tribunal and Determination No. 1 of 2005 for Members of the Legislative Assembly, Members of the Executive Council and Ministers of the Territory. (Paper 307)
          Ms Martin made a statement relating thereto.
          Ms Martin moved – That the Assembly take note of the Report and sought leave to continue her remarks at a later hour.
