Minutes of Proceedings - 2004-08-26

1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable L. M. Braham, took the Chair.

2. PRAYERS.

3. VISITORS:
      The Speaker advised Members of the presence in the public gallery of Wagaman Primary School students participating in the “Boys in Education” program accompanied by Mr Gary Fry.
      On behalf of all members the Speaker extended a warm welcome to the visitors.
4. HANSARD CORRECTIONS TO ROADS PROGRAM MINISTERIAL STATEMENT – STATEMENT BY SPEAKER:
      The Speaker advised Members to deliver Daily Hansard corrections of their debates on the Roads Program Ministerial Statement, conducted on the 25 August 2004, to the Table Office by the end of this day.

5. MINISTERIAL REPORTS:
      Festival of Darwin 2004: The Chief Minister (Ms Martin) reported on the conduct of the festivities and arts programs associated with the Festival of Darwin.
      Mr Mills responded thereto.
      Ms Martin responded accordingly.

      Defence Expenditure: The Minister for Defence Support (Mr Henderson) reported on the development of partnership agreements to expand and increase the capability of Territory defence support industries.
      Mr Burke responded thereto.
      Mr Henderson responded accordingly.

      Secondary Education Review: The Minister for Employment, Education and Training (Mr Stirling) reported on the community consultation strategy and outcomes of forums to garner feedback to the recommendations contained in the Secondary Education Review.
      Dr Lim responded thereto.
      Mr Wood responded thereto.
      Mr Stirling responded accordingly.

      Government and Non-Government Partnerships: The Minister for Family and Community Services (Ms Scrymgour) reported on the signing of a Memorandum of Understanding with Government and Non-Government Organisations for welfare recovery services during natural disasters and emergency situations.
      Ms Carter responded thereto.

      Ministerial Reports noted, pursuant to Sessional Orders.

6. POISONS AND DANGEROUS DRUGS AMENDMENT BILL 2004 (Serial 247):
      The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act to amend the Poisons and Dangerous Drugs Act.
      Bill read a first time.
      Dr Toyne moved – That the Bill be now read a second time.
      Debate ensued.
      On the motion of the Member for Port Darwin (Ms Carter) debate was adjourned.


7. CHILD PROTECTION (OFFENDER REPORTING AND REGISTRATION) BILL 2004 (Serial 246):
      The Minister for Police, Fire and Emergency Services (Mr Henderson), pursuant to notice, presented a Bill for an Act to require certain offenders who commit sexual or certain other serious offences against children to keep police informed of their whereabouts and other personal details for a period of time in order to reduce the likelihood that they will re-offend and in order to facilitate the investigation and prosecution of any future offences that they may commit, to prohibit certain offenders from working in child-related employment, to enable courts to make orders prohibiting certain offenders from engaging in specified conduct, and for related purposes.
      Bill read a first time.
      Mr Henderson moved – That the Bill be now read a second time.
      Debate ensued.
      On the motion of the Member for Araluen (Ms Carney) debate was adjourned.
8. TANAMI EXPLORATION AGREEMENT RATIFICATION BILL 2004 (Serial 242):
      The Order of the Day having been read for the resumption of debate on the question – That the Bill be now read a second time –

      Bill read a second time.
      Leave granted for a motion for the third reading of the Bill to be moved forthwith.
      On the motion of the Minister for Mines and Energy (Mr Vatskalis) the Bill was read a third time and passed to be a proposed law.
9. EDUCATION AND TRAINING – MINISTERIAL STATEMENT – MOTION TO NOTE STATEMENT:
      The Minister for Employment, Education and Training (Mr Stirling) made a statement relating to the progress of government commitments to education and training.
      Mr Stirling moved – That the Assembly take note of the Statement.
      Debate ensued.

10. VISITORS:
      The Speaker advised Members of the presence in the public gallery of -
St John’s College Year 8 boarding students from Northern Territory and Western Australian remote communities; and
Baul Folk Musicians from India, Mr Purna Das Baul, Mr Dibeyndu Das Baul, Mr Sukumar Das; and Mr Rabi Shankar Bhattacharya.
Mr Fred Finch a former Member of the Northern Territory Legislative Assembly for the electoral division of Leanyer.

      On behalf of all Members the Speaker extended a warm welcome to the visitors.
11. NOTICES:
      The following notices were given:
      Mr Mills: To move – That,

              1. This Assembly, establish a Select Committee to investigate the community benefits and merits of the transfer of the Northern Territory Parks Estate to the Land Councils, proposed by the Government and that this Committee:
                  (a) be a bi-partisan committee of the parliament comprising three members of government and three members of the opposition and one independent member;

                  (b) establish its own terms of reference as it sees fit. In doing so it being unfettered in the terms and scope of its inquiry into the proposal; and

                  (c) be given a budget appropriate for it to do its work.
              2. The Committee report to the Assembly by December 2004.

      Mr Elferink: To move – That the Assembly refer to the Public Accounts Committee for investigation and report into the following matters:

              (a) the cost to the Northern Territory of the original pool fencing scheme prior to its amendment;

              (b) the cost to the Northern Territory of the pool fencing scheme after its major amendment;

              (c) the cost of all advertising and promotion of the scheme; and the costs incurred by Territorians who in an attempt to comply with the schemes that have not been recoverable under compensation packages because of the criteria applied by Government.

              And the Committee report to the Assembly by the February sittings in 2005.
      Ms Carter: To move – That the Assembly refer to the Sessional Committee on the Environment and Sustainable Development:
              1. The disposal and storage of waste products by the Northern Territory Government institutions, including -
                  (a) storage and disposal of all biological material;
                  (b) storage and disposal of body parts;
                  (c) storage and disposal of any radioactive material; and
                  (d) storage and disposal of any chemical product.

              2. The Committee report to the Assembly by the February sittings 2005.

      The Leader of Government Business (Mr Henderson) asked that further questions be placed on the Written Question Paper.

      Answer to question: The Minister for Police, Fire and Emergency Services (Mr Henderson) answered a question asked earlier this day relating to the awarding of a contract to MSC Guards and Patrols Pty Ltd.
13. EDUCATION AND TRAINING – MINISTERIAL STATEMENT – STATEMENT NOTED:
      The Order of the Day having been read for the resumption of debate, suspended earlier this day, on the question – That the Assembly take note of the Statement –
      Debate resumed.
      The Leader of the Opposition (Mr Mills) moved the following amendment –
      Omit all words after “That” and insert in its stead –

      This Assembly calls on the Northern Territory Government to note the calls from teachers, parents and students from across the Territory to:

      1. Guarantee that the NT Open Education Centre will remain open and its services enhanced so that it can continue to serve Territorians as the Territory’s premier distance education facility.

      2. Reject the recommendation to create Learning Precincts as it will reduce the authority of local school councils and principals.

      Extension of time: On the motion of the Member for Greatorex (Dr Lim) the Leader of the Opposition (Mr Mills) was granted and extension of time.

      3. Continue the policy to devolve powers to the local school community and to put authority into the hands of parents rather than centralising governance through Learning Precincts.
      4. Increase the support for local school councils.

      5. Reject the recommendation to transfer Year 10 to the Casuarina Senior College.

        Question – That the amendment moved by Mr Mills be agreed to.

        Extension of time: On the motion of the Member for Wanguri (Mr Henderson) the Minister for Employment, Education and Training (Mr Stirling) was granted an extension of time.
