Minutes of Proceedings - 2004-02-19

1. MEETING:
      The Assembly met at 12 Noon, pursuant to advice published to Members by the Speaker. The Speaker, the Honourable L. M. Braham, took the Chair.

2. PRAYERS.

3. MINISTERIAL REPORTS:
      Desert Knowledge Centre, Construction: The Minister for Central Australia (Dr Toyne) reported on the construction phase of the Desert Knowledge precinct in Alice Springs.
      Dr Lim responded thereto.
      Dr Toyne responded accordingly.

      Tennant Creek, Mining Industry: The Minister for Mines and Energy (Mr Vatskalis) reported on the status of the mining industry in Tennant Creek.
      Mr Dunham responded thereto.
      Mr Vatskalis responded accordingly.

      Booya, Shipwreck: The Minister for Environment and Heritage (Ms Scrymgour) reported on the shipwreck site of the Schooner Booya in Darwin Harbour and the issue by the Minister of an interim heritage order.
      Mr Baldwin responded thereto.
      Ms Scrymgour responded accordingly.

      Ministerial Reports noted, pursuant to Sessional Order.
4. RADIATION PROTECTION BILL 2004 (Serial 203):
      The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act about the protection of people and the environment from harmful radiation, and for related purposes.
      Bill read a first time.
      Dr Toyne moved – That the Bill be now read a second time.
      Debate ensued.
      On the motion of the Member for Port Darwin (Ms Carter) debate was adjourned.
5. ANIMAL WELFARE AMENDMENT BILL 2004 (Serial 204):
      The Minister for Local Government (Mr Ah Kit), pursuant to notice, presented a Bill for an Act to amend the Animal Welfare Act.
      Bill read a first time.
      Mr Ah Kit moved – That the Bill be now read a second time.
      Debate ensued.
      On the motion of the Member for Macdonnell (Mr Elferink) debate was adjourned.
6. FIRE AND EMERGENCY AMENDMENT BILL 2004 (Serial 202):
      The Minister for Police, Fire and Emergency Services (Mr Henderson), pursuant to notice, presented a Bill for an Act to amend the Fire and Emergency Act.
      Bill read a first time.
      Mr Henderson moved – That the Bill be now read a second time.
      Debate ensued.
      On the motion of the Member for Macdonnell (Mr Elferink) debate was adjourned.
7. FIREARMS AMENDMENT BILL (No. 2) 2003 (Serial 194):
      The Order of the Day having been read for the resumption of debate on the question – That the Bill be now read a second time -

      Answer to questions: The Chief Minister (Ms Martin) responded to a question asked earlier this day relating to a tender for the construction of a water treatment plant at Nitmiluk National Park.
9. FIREARMS AMENDMENT BILL (No. 2) 2003 (Serial 194):
      The Order of the Day having been read for the resumption of debate, suspended earlier this day, on the question – That the Bill be now read a second time -
      Debate resumed.

      The Assembly proceeded to resolve itself into Committee of the Whole for consideration of the Bill.

      Clauses 1 to 21, by leave, taken together and agreed to.
      Clause 22 read.
      On the motion of the Minister for Police, Fire and Emergency Services (Mr Henderson) the following amendment was agreed to, after debate.
      Omit from proposed section 68A(1) the words “must not sell” and substitute “must not, in trade or commerce, sell”.

      On the motion of Mr Henderson the following further amendment was agreed to, after debate.
      Omit from proposed section 68A(2) the words “must not sell” and substitute “must not, in trade or commerce, sell”.

      On the motion of Mr Henderson the following further amendment was agreed to, after debate.
      Omit proposed sections 68A(3) and 68A(4).

      On the motion of Mr Henderson the following further amendment was agreed to, after debate.
      Omit from proposed section 68A(5) the words “person who sells” and substitute “person who, in trade or commerce, sells”.

      Clause 22, as amended, agreed to.
      Remainder of the Bill, by leave, taken as a whole and agreed to.
      Bill to be reported with amendments.

      The Speaker (Mrs Braham) resumed the Chair; the Chairman (Mr Wood) reported and accordingly and the report was adopted.
      On the motion of the Minister for Police, Fire and Emergency Services (Mr Henderson) the Bill was read a third time and passed to be a proposed law.
10. FOOD BILL 2003 (Serial 197):
      The Order of the Day having been read for the resumption of debate on the question – That the Bill be now read a second time -
      Debate resumed.

11. EMPLOYMENT AND TRAINING PROGRESS REPORT 2003 AND AGENDA 2004 – MINISTERIAL STATEMENT - STATEMENT NOTED:
      The Minister for Employment, Education and Training (Mr Stirling) made a statement relating to employment and training in 2003 and outlined the training agenda for 2004.
      Mr Stirling moved – That the Assembly take note of the Statement.
      Debate ensued.
      Question – put and passed.
12. MULTICULTURALISM – MINISTERIAL STATEMENT – STATEMENT NOTED:
      The Minister for Ethnic Affairs (Mr Vatskalis) made a statement relating to multiculturalism in the Territory.
      Mr Vatskalis moved – That the Assembly take note of the Statement.
      Debate ensued.
      Extension of time: On the motion of the Minister for Ethnic Affairs (Mr Vatskalis) an extension of time was granted to the Member for Nightcliff (Ms Lawrie), pursuant to Standing Order 77.
      Debate continued.
      Question – put and passed.
13. ADJOURNMENT:
      The Chief Minister (Ms Martin) moved – That the Assembly do now adjourn.
