1. MEETING:
      The Assembly met at 9.30am. The Speaker, the Honourable L. M. Braham, took the Chair.

2. PRAYERS.

3. STATEMENT BY SPEAKER:
      The Speaker advised Members of the change made to the speech time clock to a digital format in order that timing indications for Member's speeches are clearly evident. Madam Speaker apologised to Members for the errors which occurred yesterday in which some Members were deprived of their time allotment for their speeches.

4. PAPER TABLED:
      The Member for Macdonnell (Mr Elferink), by leave, laid on the Table a copy of a letter to replace a letter tabled yesterday from Mr Mills (Leader of the Opposition) to the Hon Paul Henderson, dated 16 August 2004 (Paper 1668) .
5. MINISTERIAL REPORTS:
      Larapinta Trail: The Minister for Tourism (Ms Martin) reported on a new Management Strategy for the Larapinta Trail.
      Mr Elferink responded thereto.
      Ms Martin responded accordingly.

      Crime and Justice Statistics, December 2004 Quarter: The Minister for Justice and Attorney-General (Dr Toyne) reported on the improved outcomes for crime solving and the downward trends to crimes being committed as reported in the Department of Justice crime statistics, December 2004 Quarter.
      Ms Carney responded thereto.
      Dr Toyne responded accordingly.

      Public Housing in Alice Springs: The Minister for Housing (Mr Ah Kit) reported on the provision of public housing for disadvantaged and elderly tenants, Home Territory 2010.
      Mr Elferink responded thereto.
      Mr Ah Kit responded accordingly.

      Road Transport Hall of Fame: The Minister for Transport and Infrastructure (Dr Burns) reported on the grant of a parcel of land and associated government funding assistance to the Road Transport Hall of Fame in Darwin.

6. TRANS-TERRITORY PIPELINE AND BLACKTIP GAS PROJECTS (SPECIAL PROVISIONS) BILL 2005 (Serial 285):
      The Chief Minister (Ms Martin), pursuant to notice, presented a Bill for an Act to make special provisions for the Trans-Territory Pipeline Project and the Blacktip Gas Project, and for related purposes.
      Bill read a first time.
      Ms Martin moved - That the Bill be now read a second time.
      Debate ensued.

      The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act to amend and repeal various Acts administered by the Minister for Justice and Attorney-General.

      Mr McAdam: To move - That the terms of reference of the Northern Territory Statehood Steering Committee adopted on 17 August 2004 be amended by inserting the following new clause after clause 5 -
              5A. Continuance of Administrative Function
              (1) Despite Clauses 4 and 5, members of the Statehood Steering Committee who are not Members of the Legislative Assembly continue in office until the Assembly first meets following prorogation of the Assembly.

              (2) The members who continue in office under subclause (1) may carryout the administrative functions of the Statehood Steering Committee and any other activities of the Statehood Steering Committee previously authorised by the Legal and Constitutional Affairs Committee, but must not carry out any other functions or activities.

      The Member for Araluen (Ms Carney) moved a motion to censure the Minister for Health (Dr Toyne) and the government -
      The Leader of Government Business (Mr Henderson) informed the Assembly that the Government accepted the motion as a censure motion, pursuant to Standing Order 95.

      The Leader of Government Business (Mr Henderson) asked that further questions be placed on the Written Question Paper.

18. CENSURE OF THE MINISTER FOR HEALTH AND GOVERNMENT - RE ALICE SPRINGS HOSPITAL SAFETY DEFECTS - MOTION NEGATIVED:
      The Member for Araluen (Ms Carney) thereupon moved - That the Assembly censure the Minister for Health (Dr Toyne) and the Martin government for:

      (a) failing to act in response to a report of April 2003 detailing fire safety and other defects at the Alice Springs Hospital that potentially compromised the safety of patients, staff and visitors to the Hospital;

      (b) refusing to table or make public any or all of the 24 reports and assessments that exits regarding the fire safety and other safety defects at the Hospital;

      (c) misleading Territorians by constant reassurances that recruitment of nurses was going well when that was, and is not the case;

      (d) mismanagement of the Alice Springs Hospital, and presiding over low staff morale and on-going industrial action brought about by frustrated and exhausted nurses; and

      (e) presiding over a waiting list of 1600 people in Alice Springs. (Paper 1675)
