Minutes of Proceedings - 2005-05-04

1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable L. M. Braham, took the Chair.

2. PRAYERS.

3. ROUTINE OF BUSINESS, ORDER OF BUSINESS:
      The Leader of Government Business (Mr Henderson) moved – That the Routine of Business of the Assembly be rearranged or suspended, if a question or debate is before the Chair, so as to permit the Leader of the Opposition to deliver his response to the Budget 2005/2006 at 11am this day.
      Question – put and passed.

4. BROADCAST OF BUDGET SPEECH 2005/2006 - STATEMENT:
      The Speaker advised Members that permission had been given for various media to broadcast live or rebroadcast, with sound and vision, the Leader of the Opposition’s Speech in response to the Budget 2005/2006; for 8 TOP FM Radio to broadcast live the presentation of the Budget 2005/2006 response of the Leader of the Opposition to the Treasurer’s Speech; and the Northern Territory News to take photographs.

5. VISITORS:
      The Speaker advised Members of the presence in the public gallery of Millner Primary School, Year 6/7 students accompanied by Ms Cathy Deans.
      On behalf of all Members the Speaker extended a warm welcome to the visitors.

6. PETITIONS:
      The Member for Brennan (Mr Burke), by leave, presented a petition not conforming with Standing Orders from 614 petitioners requesting the establishment of an oncology unit at Royal Darwin Hospital (Paper 1701).
      Petition read.

      The Member for Drysdale (Mr Dunham) presented a petition from 140 petitioners requesting a review of the location of the detention facility in Marlow Lagoon (Paper 1702).
      Petition read.
7. CONDOLENCE – NIAS HUMANITARIAN MISSION, NINE AUSTRALIAN MILITARY PERSONNEL – MOTION AGREED TO:
      The Speaker advised Members of the deaths of nine service men and women on the 2 April 2005 on a humanitarian mission following earthquake damage on the Indonesian island of Nias.
      The Chief Minister (Ms Martin), by leave, moved - That this Assembly express its deep regret at the deaths on the 2 April 2005 of the nine Australian military personnel on the island of Nias in Indonesia and place on record its appreciation of the humanitarian mission provided by these officers following the earthquake damage on Nias.

      The Chief Minister (Ms Martin) thereupon addressed the Assembly.
      Debate ensued.
      Question – put and passed.

      As a mark of respect members stood in their places for one minute, in silence.
8. MINISTERIAL REPORTS:
      Arafura Games 2005: The Minister for Sport and Recreation (Mr Ah Kit) reported on the highlights of the upcoming 2005 Arafura Games.
      Mr Elferink responded thereto.
      Mr Ah Kit responded accordingly.

      Japanese Air-Charters, Alice Springs: The Chief Minister (Ms Martin) reported on direct air charter flights to Alice Springs arranged by Nippon Travel Agency and Kintetsu and associated benefits to the tourism industry in Alice Springs.
      Mr Mills responded thereto.
      Ms Martin responded accordingly.

      Traffic Lights, Darwin Region: The Minister for Transport and Infrastructure (Dr Burns) reported on the number of traffic lights between Darwin City and Berrimah intersection through to Darwin's the rural area.
      Paper tabled: The Minister for Transport and Infrastructure (Dr Burns) presented the following Paper -
Letter, Dr Burns, Minister for Transport and Infrastructure to Hon Jim Lloyd MP, Minister for Local Government, Territories and Roads re Tiger Brennan Drive and Roads to Recovery Programme of the Commonwealth, dated 25 April 2005
(Paper 1703).

      Mr Dunham responded thereto.
      Mr Wood responded thereto.
      Dr Burns responded accordingly.

      Mt Todd Environmental Management: The Minister for Mines and Energy (Mr Vatskalis) reported on the management of pollution and rehabilitation of the Mt Todd gold mine site and associated river system.
      Mrs Miller responded thereto.
      Mr Vatskalis responded accordingly.

      Ministerial Reports noted, pursuant to Sessional Order.
9. PAY-ROLL TAX AMENDMENT BILL 2005 (Serial 288), TAXATION (ADMINISTRATION) AMENDMENT BILL 2005 (Serial 289); AND STAMP DUTY AMENDMENT BILL 2005 (Serial 290):
      Suspension of Standing Orders – Take two Bills together: The Treasurer (Mr Stirling) moved - That so much of Standing Orders be suspended as would prevent three Bills entitled, Pay-roll Tax Amendment Bill 2005 (Serial 288), Taxation (Administration) Amendment Bill 2005 (Serial 289); and Stamp Duty Amendment Bill 2005 (Serial 290) -
      (a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings; the Committee’s report stage; and the third readings of the Bills together; and
      (b) the consideration of the Bills separately in the Committee of the Whole.

      Question – put and passed.
      The Treasurer (Mr Stirling), pursuant to notice, presented a Bill for a Act to amend the Pay-roll Tax Act; a Bill for an Act to amend the Taxation (Administration) Act; and a Bill for an Act to amend the Stamp Duty Act.
      Bills read a first time.
      Mr Stirling moved – That the Bills be now read a second time.
      Debate ensued.
      On the motion of the Leader of the Opposition (Mr Burke) debate was adjourned.
10. APPROPRIATION BILL 2005/2006 (Serial 287):
      The Order of the Day having been read for the resumption of debate on the question, pursuant to resolution passed earlier this day to allow the Leader of the Opposition to respond to the Budget 2005/2006 at 11 am - That the Bill be now read a second time -
      The Leader of the Opposition (Mr Burke) thereupon delivered his response to the 2005/2006 Budget.
      On the motion of the Leader of Government Business (Mr Henderson) debate was adjourned.
11. OMBUDSMAN FOR THE NORTHERN TERRITORY, ADMINISTRATIVE ACTIONS OF GOVERNMENT AUTHORITIES - MOTION TO NOTE REPORT:

16. NORTHERN TERRITORY STATEHOOD STEERING COMMITTEE MEMBERSHIP AND SPEAKER’S DETERMINATION No. 5 FOR SITTING FEES AND ALLOWANCES – PAPERS TABLED:
      The Speaker, pursuant to the Terms of Reference of the Northern Territory Statehood Steering Committee adopted by the Assembly on 17 August 2004 laid on the Table -

      1. an extract of Minutes of Proceedings of the Standing Committee on Legal and Constitutional Affairs Committee dated 3 March 2005 and 21 April 2005 respectively, appointing the membership and Co-Chair of the Northern Territory Statehood Steering Committee (Paper 1707); and

      2. a copy Speaker's Determination No. 5 in respect of sitting fees and travel allowances for members of the Northern Territory Statehood Steering Committee (Paper 1708).

17. NORTHERN TERRITORY STATEHOOD STEERING COMMITTEE MEMBERSHIP AND SPEAKER’S DETERMINATION FOR SITTING FEES AND ALLOWANCES – MOTION AGREED TO, DOCUMENTS ADOPTED:
      The Chairman of the Legal and Constitutional Affairs Committee (Mr Mc Adam), by leave, moved - That the Assembly, pursuant to the Assembly resolution of 17 August 2004, adopt -

      1. The membership and Co-Chair of the Northern Territory Statehood Steering Committee appointed by the Legal and Constitutional Affairs Committee Minutes of Proceedings respectively, of 3 March 2005 and 21 April 2005; and

      2. Speaker’s Determination No. 5 of 2005 tabled this day authorising meeting/sitting fees and travel allowances for the Northern Territory Statehood Steering Committee.
