Minutes of Proceedings - 2004-10-07

1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable L. M. Braham, took the Chair.
2. PRAYERS.

3. VISITORS:
      The Speaker advised Members of the presence in the public gallery of O’Loughlin College Year 11 politics students accompanied by Mr Stenchion.
      On behalf of all Members the Speaker extended a warm welcome to the visitors.
4. MINISTERIAL REPORTS:
      Bayu-Undan Offshore Gas Field: The Chief Minister (Ms Martin) reported on the construction phase of the LNG plant storage facility in Darwin and the Bayu-Undan offshore gas field complex.
      Mr Dunham responded thereto.
      Ms Martin responded accordingly.

      Secondary Education, Alice Springs Charles Darwin University Campus: The Minister for Employment, Education and Training (Mr Stirling) reported on the delivery of secondary education in the Alice Springs campus of the Charles Darwin University.
      Dr Lim responded thereto.
      Mr Stirling responded accordingly.

      Sabah Expo Visit: The Minister for Business and Industry (Mr Henderson) reported on his recent visit to Sabah and the Philippines to promote trade between the Territory and Malaysia.
      Mr Mills responded thereto.
      Mr Henderson responded accordingly.

      Sabah, Cattle exports: The Minister for Primary Industry and Fisheries (Mr Vatskalis) reported on his visit to Sabah to promote trade in agricultural products and live cattle exports from the Territory.
      Mr Baldwin responded thereto.
      Mr Vatskalis responded accordingly.

5. PROFESSIONAL STANDARDS BILL 2004 (Serial 252):
      The Minister for Employment, Education and Training (Mr Stirling), pursuant to notice presented a Bill for an Act to provide for the limitation of liability of members of occupational associations in certain circumstances and to facilitate improvement in the standards of services provided by those members.
      Bill read a first time.
      Mr Stirling moved – That the Bill be now read a second time.
      Debate ensued.
      On the motion of the Member for Greatorex (Dr Lim) debate was adjourned.
6. EVIDENCE REFORM (CHILDREN AND SEXUAL OFFENCES) BILL 2004 (Serial 240):
      The Order of the Day having been read for the resumption of debate on the question – That the Bill be now read a second time –

      On the motion of the Treasurer (Mr Stirling) the Minister for Justice and Attorney-General (Dr Toyne ) was granted and extension of time.

9. CENSURE OF MINISTER FOR JUSTICE AND ATTORNEY-GENERAL - NEGATIVED
      The Member for Brennan (Mr Burke) in moving a motion to suspend Standing Orders to censure the Attorney-General for his conduct towards the Shadow Minister during debate on the Evidence Reform (Children and Sexual Offences) Bill 2004 (Serial 240) and by material issued by media release -

      The Leader of Government Business (Mr Henderson) informed the Assembly that the Government accepted the motion as a censure motion, pursuant to Standing Order 95.

      Mr Burke thereupon moved – That the Assembly censure the Attorney-General for breaching Standing Order 62 which states in part…….”no Member….shall attribute directly or by innuendo to another Member unbecoming conduct or motives”.

      Debate ensued.

10. POLICE ADMINISTRATION AMENDMENT (FORENSIC PROCEDURES) BILL 2004 (Serial 241):
      The Order of the Day having been read for the resumption of debate on the question – That the Bill be now read a second time –

      The Assembly resolved itself into Committee of the Whole for consideration of the Bill.

      On the motion of the Minister for Police, Fire and emergency Services (Mr Henderson) the following amendment was agreed to, after debate.
      Omit proposed section 147B(2) and insert in its stead -
          “(2) However, if a non-intimate procedure is carried out in accordance with a person's consent under section 145B for investigating an offence, the information obtained from the procedure –
              (a) must not be used for investigating another offence other than a relevant offence; and

              (b) is inadmissible as evidence in any proceeding other than a proceeding for the offence or a relevant offence.

          (3) In this section –
              'relevant offence' means an offence that is a crime punishable by a term of imprisonment of 14 years or more.”.

12. WORK LIFE BALANCE IN PUBLIC SECTOR - MINISTERIAL STATEMENT – STATEMENT NOTED:
      The Minister for Employment, Education and Training (Mr Stirling) made a statement articulating the government’s work life balance policy and application in the Territory public sector.
      Mr Stirling moved – That the Assembly take note of the Statement.
