Minutes of Proceedings - 2002-10-17

1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable L. M. Braham, took the Chair.

2. PRAYERS.

3. MINISTERIAL REPORTS:
      Timor Sea Gas: The Chief Minister (Ms Martin) reported on the government efforts to bring gas from the Timor Sea onshore to Darwin.
      Mr Burke responded thereto.
      Ms Martin responded accordingly.

      Health Care Agreement 2002/2003: The Minister for Health and Community Services (Mrs Aagaard) reported on Commonwealth funding for health care services in the Territory for 2002/2003.
      Mr Dunham responded thereto.
      Mrs Aagaard responded accordingly.

      East Arm Wharf Open Day: The Minister for Transport and Infrastructure (Mr Vatskalis) reported on the construction progress of the East Arm Wharf, parking areas and open day conducted for the general public.

      Seniors Month, August 2002: The Chief Minister (Ms Martin) reported on the success of the events to celebrate senior’s month events.
      Mr Dunham responded thereto.
      Mr Wood responded thereto.
      Ms Martin responded accordingly.

      Reports noted, pursuant to Sessional Order.

4. NEXT MEETING:
      The Leader of Government Business (Mr Stirling) moved – That the Assembly at its rising adjourn until Tuesday 26 November 2002 at 10am or such other time and/or date as may be set by Madam Speaker, pursuant to Sessional Order.

5. PERSONAL INJURIES (LIABILITIES AND DAMAGES) BILL 2002 (Serial 108) and PERSONAL INJURIES (LIABILITIES AND DAMAGES) (CONSEQUENTIAL AMENDMENTS) BILL 2002 (Serial 109):
      Suspension of Standing Orders: The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, moved – That so much of the Standing Orders be suspended as would prevent two Bills entitled Personal Injuries (Liabilities and Damages) Bill 2002 (Serial 108) and Personal Injuries (Liabilities and Damages) (Consequential Amendments) Bill 2002 (Serial 109) -
        (a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings; the committee’s
        report stage; and the third readings of the Bills together; and

        (b) the consideration of the Bills separately in the committee of the whole.

      Question – put and passed.

      The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act to modify the law relating to the entitlement to damages for personal injuries, to clarify principles of contributory negligence, to fix reasonable limits on certain awards of damages for personal injuries, to provide for periodic payments of damages for personal injuries, and for related purposes; and a Bill for an Act to amend various Acts and Rules consequential on the enactment of the Personal Injuries (Liabilities and Damages) Act.
      Bills read a first time.
      Dr Toyne moved – That the Bills be now read a second time.
      Debate ensued.
      On the motion of the Member for Goyder (Mr Maley) debate was adjourned.
6. SWIMMING POOL FENCING BILL 2002 (Serial 106) and SWIMMING POOL FENCING (CONSEQUENTIAL AMENDMENTS) BILL 2002 (Serial 107):
      Suspension of Standing Orders: The Minister for Local government (Mr Ah Kit), pursuant to notice, moved - That so much of the Standing Orders be suspended as would prevent two Bills entitled Swimming Pool Fencing Bill 2002 (Serial 106) and Swimming Pool Fencing (Consequential Amendments) Bill 2002 (Serial 107) -
        (a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings; the committee’s
        report stage; and the third readings of the Bills together; and

        (b) the consideration of the Bills separately in the committee of the whole.

      Question – put and passed.

      The Minister for Local government (Mr Ah Kit), pursuant to notice, presented a Bill for an Act to require the registration of certain swimming pools, to require the enclosure of certain swimming pools by barriers that restrict access by children to swimming pools, and for related purposes and a Bill for an Act to amend the Residential Tenancies Act consequential on the enactment of the Swimming Pool Fencing Act..
      Bills read a first time.
      Mr Ah Kit moved – That the Bills be now read a second time.
      Debate ensued.
      On the motion of the Member for Greatorex (Dr Lim) debate was adjourned.
7. STANDING ORDERS COMMITTEE – CHANGE OF MEMBERSHIP – AGREED TO:
      The Leader of the Opposition (Mr Burke), by leave, moved – That the Member for Port Darwin (Ms Carter) be discharged from the service on the Standing Orders Committee and that the Member for Katherine (Mr Reed) be appointed in her stead.
      Question – put and passed.
8. STANDING ORDERS COMMITTEE – CODE OF CONDUCT REFERENCE, EXTENSION OF TIME TO REPORT – AGREED TO:
      The Leader of Government Business (Mr Stirling), by leave, moved – That the Standing Orders Committee be given an extension of time until February 2003 to report to the Assembly on the Code of Conduct and Ethical Standards reference provided to the Committee on 20 June 2002.
      Question – put and passed.
9. ECONOMIC DEVELOPMENT STRATEGY FOR THE TERRITORY – STATEMENT NOTED:
      The Order for the Day having been read for the resumption of debate on the question – That the Assembly take note of the Statement –

      Extension of time: On the motion of Member for Drysdale (Mr Dunham) the Member for Blain (Mr Mills) was granted an extension of time.

12. PERSONAL EXPLANATION:
      The Member for Nelson (Mr Wood), pursuant to Standing Order 57, corrected a part of his speech relating to the “approval of the Information Commissioner” appointment during debate on the Information Bills.
13. ACCESS TO NATIONAL DNA DATABASE – MINISTERIAL STATEMENT – STATEMENT NOTED:
      The Minister for Police, Fire and Emergency Services (Mr Stirling) made a statement relating to the need for the Northern Territory to have access to the National DNA database of Australia to avoid costly delays in the justice system.
      Mr Stirling moved – That the Assembly take note of the Statement.

14. ESTIMATES COMMITTEE SEPTEMBER 2002– QUESTIONS ON NOTICE AND ANSWERS, SUPPLEMENTARY ANSWERS TO QUESTIONS – PAPERS TABLED:
      The Chairman of the Estimates Committee (Dr Burns) laid on the Table –
      Questions on Notice Nos. 1969 to 2016 inclusive of their corresponding answers which arose during the public hearings conducted by the
      Estimates Committee 17 to 19 September 2002; and corresponding answers (Paper 658); and
      Supplementary answers to questions asked during the Estimates Committee hearings 17 to 19 September 2002 which Agencies have
      provided to the Committee Secretariat. (Paper 659).

      The Minister for Transport and Infrastructure (Mr Vatskalis) moved – That the Assembly do now adjourn.
