Minutes of Proceedings - 2002-10-16

1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable L. M. Braham, took the Chair.

2. PRAYERS.

3. VISITORS:
      The Speaker advised Members of the presence in the public gallery of English as a Second Language students from Nungalinya Theological College accompanied by Ms Amanda Donohoe.
      On behalf of all Members the Speaker extended a warm welcome to the visitors.

4. MINISTERIAL REPORTS:
      School Based Constables: The Minister for Police, Fire and Emergency Services (Mr Stirling) reported on a review of the operation of school based constables.
      Paper tabled: Mr Stirling laid on the Table the following Paper –
Report on the Review of the NT School Based Policing Scheme.(Paper 640)

      Mr Mills responded thereto.
      Mr Stirling responded accordingly.

      Dream Time Tourism Event: The Minister for Tourism (Mr Henderson) reported on the Dream Time tourism event hosted by the Territory government in Alice Springs on 15 and 16 September 2002.
      Ms Carney responded thereto.
      Mr Henderson responded accordingly.

      Gay and Same Gender Law Reform: The Minister for Justice and Attorney-General (Dr Toyne) reported on proposals to legislate to give same gender partners equality before the law in regard to property settlements and other avenues of legal process.
      Mr Maley responded thereto.
      Dr Toyne responded thereto.

      Battery Hill Mining Centre: The Minister for Community Development (Mr Ah Kit) made a report on the mining centre at Battery Hill and its contribution to tourism and development in the region.
      Mr Reed responded thereto.
      Mr Ah Kit responded accordingly.

      Ministerial Reports noted, pursuant to Sessional Order.
5. MOTOR ACCIDENTS (COMPENSATION) AMENDMENT BILL 2002 (Serial 102):
      The Treasurer (Ms Martin), pursuant to notice, presented a Bill for an Act to amend the Motor Accidents (Compensation) Act.

      Ms Martin moved – That the Bill be now read a second time.
      Debate ensued.
      On the motion of the Member for Goyder (Mr Maley) debate was adjourned.
6. PAY-ROLL TAX AMENDMENT BILL (No. 3) 2002 (Serial 103):
      The Treasurer (Ms Martin), pursuant to notice, presented a Bill for an Act to amend the Pay-roll Tax Act.

      The Minister for Racing, Gaming and Licensing (Mr Stirling), pursuant to notice, presented a Bill for an Act to amend the Liquor Act.

8. PETROLEUM (SUBMERGED LANDS) AMENDMENT BILL 2002 (Serial 104):
      The Minister for Business, Industry and Resource Development (Mr Henderson), pursuant to notice, presented a Bill for an Act to amend the Petroleum (Submerged Lands)Act.

      Mr Henderson moved - That the Bill be now read a second time.

9. TOBACCO CONTROL BILL 2002 (Serial 101):
      The Minister for Health and Community Services (Mrs Aagaard), pursuant to notice, presented a Bill for an Act to restrict smoking in certain public places and workplaces, to regulate packaging, advertising (including through sponsorship), and display of tobacco and other smoking products, to regulate conduct of premises at which tobacco and other smoking products are sold by retail, to prohibit sale and supply of tobacco and other smoking products to children, and for related purposes.
      Mrs Aagaard moved - That the Bill be now read a second time.
      Debate ensued.

15. INDIGENOUS PEOPLE AND THE JUSTICE SYSTEM – MINISTERIAL STATEMENT – STATEMENT NOTED:
      The Minister for Justice and Attorney-General (Dr Toyne) made a statement relating to the effect on indigenous people and the justice system in the Territory.
      Dr Toyne moved – That the Assembly take note of the Statement.
