1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable L. M. Braham, took the Chair.

3. FLAGS IN CHAMBER - STATEMENT BY SPEAKER:
      The Speaker advised Members of a decision of the House Committee to not permit the flying of the Northern Territory Flag in the Chamber and requested Members to remove flags from their Chamber desks.
      Statements made by various members, by leave.
4. PETITIONS:
      The Member for Fannie Bay (Ms Martin) presented petition No. 61 from 710 petitioners requesting that the Assembly retain the Open Education Centre in Rapid Creek. (Paper 1422)
      Petition read.

      The Member for Nelson (Mr Wood) presented petition No. 62 from 654 petitioners requesting that the Assembly retain the Open Education Centre at Rapid Creek. (Paper 1423)
      Petition identical to previous petition, petition not read.

      The Member for Brennan (Mr Burke) presented petition No. 63 from 199 petitioners requesting the Assembly to ensure that house Lot sizes for the Defence Housing Lee Point development be set at minimum of 800square metres. (Paper 1424)
      Petition read.

      The Member for Nelson (Mr Wood) presented petition No. 64 from 131 petitioners requesting that the proposed Waterfront Development of Darwin Harbour is not carried out at the expense of the history/heritage sites in the Darwin Harbour precinct. (Paper 1425)
      Petition read.
5. MINISTERIAL REPORTS:
      Women’s Forum, Jabiru: The Minister assisting the Chief Minister on Young Territorians, Women’s Policy and Senior Territorians (Ms Scrymgour) reported on the conduct of the 5th Women’s Forum at Jabiru on the occasion of Regional Cabinet meetings at Jabiru.
      Ms Carney responded thereto.
      Ms Scrymgour responded accordingly.

      Indonesia and Singapore Trade Visit: The Minister for Asian Relations and Trade (Mr Henderson) reported on his recent visit to Indonesia, Kupang, and Singapore.
      Mr Mills responded thereto.

      Boat Ramps and Recreational Fishing Infrastructure: The Minister for Parks and Wildlife (Dr Burns) reported on the upgrade of boat ramps at Buffalo Creek and Dinah Beach; development of secure car parks at Buffalo Creek Boat Ramp; and proposed new boat ramps for the Borroloola and Victoria River districts.
      Mr Baldwin responded thereto.
      Dr Burns responded accordingly.

      Child Care Centres: The Minister for Family and Community Services (Ms Scrymgour) reported on a child care subsidy payments made to Northern Territory families and subsidies provided to registered child care centres.
      Ms Carter responded thereto.
      Ms Scrymgour responded accordingly.

6. EVIDENCE REFORM (CHILDREN AND SEXUAL OFFENCES) BILL 2004 (Serial 240):
      The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act to reform Territory law in relation to the evidence of children in matters of sexual offences, and for related purposes.
      Bill read a first time.
      Dr Toyne moved – That the Bill be now read a second time.
      Debate ensued.
      Leave granted for the Member for Araluen (Ms Carney) to continue her remarks at a later hour.
      Debate adjourned.

7. TANAMI EXPLORATION AGREEMENT RATIFICATION BILL 2004 (Serial 242):
      Suspension of Standing Orders – Pass Bill through all stages: The Minister for Mines and Energy (Mr Vatskalis), pursuant to notice, moved – That so much of Standing Orders be suspended as would prevent the Tanami Exploration Agreement Ratification Bill 2004 (Serial 242) passing through all stages at this sittings.
      Question put and passed.
      Mr Vatskalis, pursuant to notice, presented a Bill for an Act to ratify an agreement between the Northern Territory of Australia and Newmont Tanami Pty Ltd, Otter Gold Pty Ltd and Newmont Gold Exploration Pty Ltd and to repeal the Granites Exploration Agreement Ratification Act.
      Bill read a first time.
      Mr Vatskalis moved – That the Bill be now read a second time.
      Debate ensued.

8. NUCLEAR WASTE TRANSPORT, STORAGE AND DISPOSAL (PROHIBITION) BILL 2004 (Serial 243):
      The Minister for Environment and Heritage (Ms Scrymgour), pursuant to notice, presented a Bill for an Act to prohibit the transport into the Territory, and the storage and disposal in the Territory, of certain nuclear waste, and for related purposes.
      Bill read a first time.
      Ms Scrymgour moved – That the Bill be now read s second time.
      Debate ensued.
      Leave granted for the Member for Brennan (Mr Burke) to continue his remarks at a later hour.

      On behalf of all Members the Speaker extended a warm welcome to the distinguished visitors.

      The Member for Macdonnell (Mr Elferink) in moving a motion to suspend Standing Orders to allow him to move a motion of censure, and withdrawing his last question to Mr Ah Kit –
      The Leader of Government Business (Mr Henderson) informed the Assembly that the Government accepted the motion as a censure motion, pursuant to Standing Order 95.

      The Leader of Government Business (Mr Henderson) asked that written questions be placed on the Written Question Paper.
13. CENSURE OF GOVERNMENT – RE OWSTON NOMINEES AND WARREN ANDERSON, PROSECUTION OF ANIMAL WELFARE ISSUES ON TIPPERARY STATION – MOTION NEGATIVED:
      The Member for Macdonnell (Mr Elferink) thereupon moved – That the Assembly censure the Government for their outrageous conduct in their fanatical pursuit of Owston Nominees and particularly Warren Anderson;

      And for the reckless indifference they have shown to the proper processes of justice in the Northern Territory;

      And lying to this house and Territorians about their role in the pursuit of this matter.

      Debate ensued.

17. BUILDING OUR POLICE FORCE AND POLICE RESOURCING INITIATIVES – MINISTERIAL STATEMENT – STATEMENT NOTED:
      The Minister for Police, Fire and Emergency Services (Mr Henderson) made a statement relating the implementation of a four-year $75m plan to Build our Police Force.
      Mr Henderson moved – That the Assembly take note of the Statement.
