1. MEETING:
      The Assembly met at 10am, pursuant to resolution of the Assembly, dated Friday 25 June 2004. The Speaker, the Honourable L. M. Braham, took the Chair.

    4. PETITION:
        The Member for Fannie Bay (Ms Martin) presented petition No. 60, from 347 petitioners, requesting the Assembly to protect the Daly River from subdivision of Pastoral Leases for large scale irrigated agriculture, and the issuing of tree-clearing permits or water extraction licences. (Paper 1420)
        Petition read.

        Responses to petitions: The Clerk, pursuant to Standing Order 100A, advised – That, a response to petitions No. 56 [drinking water Dundee Beach] and No. 58 [Mandorah Boat Ramp] had been received and circulated to Members and the terms of the responses would be included in the Hansard record. (Paper 1399)

    5. MINISTERIAL REPORTS:
        Acting Electoral Commissioner: The Chief Minister (Ms Martin) reported on the appointment of an Acting Electoral Commissioner Mr Phillips for 3 months during the absence of the Electoral Commissioner Mr K Heisner who will assist the United Nations in IRAQ to establish an electoral program.
        Mr Mills responded thereto.
        Ms Martin responded accordingly.

        Bradley Case: The Minister for Justice and Attorney-General (Dr Toyne) reported on the outcomes of the case against Chief Magistrate Bradley v Naalas.
        Ms Carter responded thereto.
        Dr Toyne responded accordingly.

        Multicultural Awards: The Minister for Ethnic Affairs (Mr Vatskalis) reported on the conduct and promotion of the inaugural Northern Territory Multicultural Awards, under four categories.
        Dr Lim responded thereto.
        Mr Vatskalis responded accordingly.

        Defence Contracts: The Minister for Defence Support (Mr Henderson) reported on the affects on the Territory’s small business community by the change in the management of defence contracts by the Commonwealth.
        Mr Burke responded thereto.

        Ministerial Reports noted, pursuant to Sessional Order.

    6. NORTHERN TERRITORY STATEHOOD STEERING COMMITTEE – MOTION TO ADOPT TERMS OF REFERENCE – MOTION AGREED TO:
        The Order of the Day having been read for the resumption of debate on the question, adjourned 25 June 2004 –

        That the Assembly –

        (a) endorse the Terms of Reference of the Northern Territory Statehood Steering Committee, tabled on 25 June 2004; and

        (b) authorise the Standing Committee on Legal and Constitutional Affairs to appoint the membership of the Northern Territory Statehood Steering Committee in accordance with the Terms of Reference;
            subject to –
            the Speaker tabling in the Assembly for its adoption –

            (i) the membership of the Northern Territory Statehood Steering Committee; and
              (ii) a Speaker’s Determination authorising the level and terms and conditions of payment of meeting/sitting fees and travel allowances to be paid to Northern Territory Statehood Steering Committee members, pursuant to paragraphs 48 to 50 of the Terms of Reference referred to in paragraph (a) above; and
            (c) notwithstanding paragraph 4 of the Terms of Reference, may by resolution dissolve the Northern Territory Statehood Steering Committee.
              And the amendment moved by (Mr Dunham) –
              Omit all words after “That” and insert in their stead –
                  “the document entitled “Terms of Reference, Northern Territory Statehood Steering Committee” be held in abeyance and used by members for consultation and discussion and be put forward for further debate in the Assembly at the next sittings.”.
              The Leader of Government Business (Mr Henderson), by leave, made a statement to the Assembly relating to the procedure for continuing debate on the motion and sought leave for the Member for Brennan (Mr Burke) to speak again to the question.
              Leave granted.

              Ruling – lapsed motion: The Speaker advised Members that it was her ruling that the amendment moved by Mr Dunham to the motion had lapsed due to the effluxion of time.
              The Member for Brennan (Mr Burke), by leave, addressed the Assembly.

          7. REMUNERATION TRIBUNAL AMENDMENT BILL 2004 (Serial 236) and MAGISTRATES AMENDMENT BILL 2004 (Serial 237):
              The Order of the Day having been read for the resumption of debate on the question – That the Bills be now read a second time -
              Debate resumed.
              Question – put and passed.
              Bills read a second time.
              The Member for Brennan (Mr Burke), by leave, made a statement.
              The Minister for Justice and Attorney-General (Dr Toyne), by leave, responded thereto.
              Leave granted for a motion for the third readings of the Bills to be moved forthwith.
              On the motion of the Minister for Justice and Attorney-General (Dr Toyne) the Bills were read a third time and passed to be proposed laws.

          8. AUDITOR-GENERAL’S AUGUST 2004 REPORT TO THE LEGISLATIVE ASSEMBLY – PAPER TABLED – PRINT – MOTION TO NOTE REPORT:
              The Speaker laid on the Table the Auditor-General’s August 2004 Report to the Legislative Assembly (Paper 1419).
              The Chief Minister (Ms Martin) moved – That the Report be printed.
              Question – put and passed.
              Ms Martin moved – That the Assembly take note of the Report and that leave be granted to continue her remarks at a later hour.

          9. TIMOR SEA GAS FIELDS, DEVELOPMENT OPPORTUNITIES –MINISTERIAL STATEMENT – MOTION TO NOTE STATEMENT:
              The Chief Minister (Ms Martin) made a statement relating to the Northern Territory Government’s strategic approach to the development and enhancement of opportunities for the Territory economy to benefit from gas projects in the Timor Sea.
              Ms Martin moved – That the Assembly take note of the Statement.
              Debate ensued.
