1. MEETING:
The Assembly met at 10.00 a.m., pursuant to adjournment.
The Speaker, the Honourable T.R. McCarthy, took the Chair.

2. PRAYERS.

3. ADDRESS-IN-REPLY - PRESENTATION TOAND MESSAGE FROM HER MAJESTY THE QUEEN:
The Speaker advised Honourable Members that Sir Kenneth Scott, KCVO, CMG, Deputy Private Secretary to Her Majesty, had advised the Office of the
Administrator that he had placed the Address-in-Reply before Her Majesty. Her Majesty requested that he pass on her very warm thanks to the Administrator,
the Honourable Austin Asche, AC QC and the Legislative Assembly of the Northern Territory for their kind message of loyalty.

4. DISTINGUISHED VISITOR:
The Speaker (Mr McCarthy) drew the attention of Honourable Members to the presence in the gallery of Mr Suhardibroto, Deputy Attorney-General
for Civil Law for the Republic of Indonesia.
On behalf of Honourable Members, the Speaker extended a warm welcome to the distinguished visitor.

5. VISITORS:
The Speaker (Mr McCarthy) drew the attention of Honourable Members to the presence in the gallery of Grade 7 students from Wanguri Primary School
and their teacher, Malcolm Taylor; members of the Nhulunbuy High School basketball teams; and members of the Filipiniana Senior Citizens Association.
On behalf of Honourable Members, the Speaker extended a warm welcome to the visitors.

6. NOTICE:
The following notice was given -
Mr Coulter: To move - That -

(1) a committee to be known as the Select Committee on Effects of Poker Machines in Community Venues be appointed,
representation comprising two Government and one Opposition Member, unless otherwise ordered;

(2) the Committee be empowered to inquire into and report on:

(a) the personal, social and economic consequences for individuals, families and the community at large
from the availability of poker machines in community venues;

(b) the means by which any negative impacts of poker machines in community venues can be minimised;

(c) the form and extent of regulatory mechanisms, covering the positioning, ownership, operation and control of
poker machines in community venues, necessary to ensure that fairness, efficiency and integrity are maintained;

(3) the Committee be empowered to send for persons, papers and records, to sit in public or in private session notwithstanding any
adjournment of the Assembly and to adjourn from place to place. The committee shall report to the Assembly in February 1995;

(4) the Committee be empowered to publish from day to day such papers and evidence as may be ordered by it and, unless ordered
by the committee, a daily Hansard be published of such proceedings as take place in public; and

(5) the foregoing provisions of this resolution, so far as they are inconsistent with Standing Orders, have effect notwithstanding
anything contained in these Standing Orders.

8. PERSONAL EXPLANATION:
The Member for Macdonnell (Mr Bell), by leave, made a personal explanation relating to comments made by the Leader of Government Business

9. PIRLANGIMPI COMMUNITY GOVERNMENT SCHEME - PAPER TABLED - PAPER NOTED:
The Minister for Lands, Housing and Local Government (Mr Hatton) laid on the Table the replacement for the Pirlangimpi Community Government Scheme (Paper 213).

15. TERRITORY PARKS AND WILDLIFE CONSERVATION AMENDMENT BILL 1994 (Serial 45); and PETROLEUM (SUBMERGED LANDS) AMENDMENT BILL 1994 (Serial 43):
Suspension of Standing Orders - Take two Bills together:
The Minister for Conservation (Mr Coulter) moved - That so much of Standing Orders be suspended as would prevent two Bills, namely the Territory Parks and Wildlife
Conservation Amendment Bill 1994 (Serial 45) and the Petroleum (Submerged Lands) Amendment Bill 1994 (Serial 43) -

(a) being presented and read a first time together and one motion being put in regard to, respectively, the
second readings, the Committee's report stage, and the third readings of the Bills together; and

(b) the consideration of the Bills separately in the Committee of the Whole.

Question - put and passed - there being an absolute majority of the whole number of Members present and no dissentient voice.
Mr Coulter, pursuant to notice, presented a Bill for an Act to amend the Territory Parks and Wildlife Conservation Act; and a Bill for

16. STAMP DUTY AMENDMENT BILL (No. 2) 1994 (Serial 40); and TAXATION (ADMINISTRATION) AMENDMENT BILL (No. 2) 1994 (Serial 39):
Suspension of Standing Orders - Take two Bills together:
The Treasurer (Mr Coulter) moved - That so much of Standing Orders be suspended as would prevent two Bills, namely the Stamp Duty
Amendment Bill (No. 2) 1994 (Serial 40) and the Taxation (Administration) Amendment Bill (No. 2) 1994 (Serial 39) -

(a) being presented and read a first time together and one motion being put in regard to, respectively, the second readings,
the Committee's report stage, and the third readings of the Bills together; and

(b) the consideration of the Bills separately in the Committee of the Whole.

Protection Council, and for related purposes.

Bill for an Act to regulate the operation of retirement villages and to confer on the Local Court powers in respect of certain matters relating to
retirement villages and for related purposes.

On the motion of Mr Palmer the following amendment was agreed to -

Omit from paragraph (a) proposed subsection (1) and insert in its stead the following:

"(1) The Director may approve a person (the "nominated person"), nominated on the approved form
by a licensee who is a natural person, to carry out operations under the licence as if the nominated
person were the licensee for the period specified in the approval, and while such an approval remains
in force the nominated person -

(a) is responsible for complying with the conditions of the licence; and

(b) is, in any proceedings taken against the nominated person for an offence
against this Act committed during that period, deemed to be the licensee,

but nothing in this section affects the liability under section 45A of the licensee for actions taken
by the nominated person or by any other person engaged in fishing operations under the licence.".

On the motion of Mr Palmer the following amendment was agreed to, after debate -

Add at the end the following:

"(c) by omitting from paragraph (c) `overexploited; and' and substituting
`overexploited;';

(d) by inserting after paragraph (c) the following:

`(ca) encourage tourist and scientific interest in fish and aquatic life; and/or'; and

(e) by adding at the end the following:

`(2) For the avoidance of doubt, "manage" in subsection (1) includes, and shall be taken always
to have included, a total prohibition against the taking of fish or aquatic life in all or part of a
fishery management area or in a fishery.'.".

On the motion of Mr Palmer the following new clause was inserted in the Bill -

"23A.REGULATORY OFFENCES

"Section 38 of the Principal Act is amended by adding at the end the following:

`(3) Subsection (2)(b) applies only to an offence prescribed in the Regulations or a fishery
management plan to be an offence to which that subsection applies.'.".

Clauses 24 to 26, by leave, taken together and agreed to.
On the motion of Mr Palmer the following new clause was inserted in the Bill -

"26A.LIABILITY OF DIRECTORS, MANAGERS AND LICENSEES

"Section 45(2) of the Principal Act is repealed.".

Clause 27 read.
On the motion of Mr Palmer the following amendment was agreed to -

Omit from proposed section 45A(1) all words after paragraph (c) and insert in their stead the following:

"(d) a person approved under section 14(1) in respect of the licence or whose name is entered in the
licensee's record book under section 14(4),

is convicted of an offence against this Act in respect of operations in relation to a licence, the licensee
is, subject to subsection (1A), guilty of thesame offence.

"(1A) It is a defence to a prosecution for an offence by the licensee that is referred to in
subsection (1) if the licensee establishes that he or she took all reasonable precautions
to prevent the commission of the offence by the other person.".

On the motion of Mr Palmer the following further amendment was agreed to -

Omit from proposed section 45A(2) all words after paragraph (a) and insert in their stead the following:

"(b) a person approved under section 14(1) in respect of the licence or whose name is entered in the
licensee's record book under section 14(4); or

(c) a person conducting operations under a licence by virtue of a temporary transfer agreement under section 12A,

who was in charge of the fishing operation at the time at which the offence was committed is, subject to subsection (2A), guilty of the same offence.

"(2A) It is a defence to a prosecution for an offence by the licensee that is referred to in subsection (1) if the licensee
establishes that he or she took all reasonable precautions to prevent the commission of the offence by the other person.".

On the motion of Mr Palmer the following new clause was inserted in the Bill -

"31A.POWERS AND FUNCTIONS OF MINISTER

"Section 58 of the Principal Act is amended by omitting 'Part IVA' and substituting 'Division 1 of Part V'.".

On the motion of Mr Palmer the following new clause was inserted in the Bill -

"35. APPLICATION OF THIS ACT TO FISHERIES IN ACCORDANCE WITH ARRANGEMENTS

"Section 65 of the Principal Act is amended by omitting 'Commonwealth proclaimed waters' (wherever
occurring) and substituting 'the Australian fishing zone'.".

Clause 36 agreed to.

On the motion of Mr Palmer the following amendment was agreed to -

Omit paragraph (b) and insert in its stead the following:

"(b) by omitting 'fisheries management plan' and substituting 'fishery management plan';

(ba) by omitting from paragraph (a) 'fisheries management area' and substituting 'fishery management area';".

Clauses 38 and 39, by leave, taken together and agreed to.

On the motion of Mr Palmer the following new clause was inserted in the Bill, after debate -

"40. VALIDATION OF CERTAIN MANAGEMENT PLANS

Notwithstanding section 63(11) of the Interpretation Act, all

(a) management plans for a fishery or fishery management area made or purporting to have been made; and

(b) notices of a kind referred to in section 49(1) of the Principal Act given or purporting to have been given,

before, and in force or purporting to be in force immediately before, the commencement of this section, have
full force and effect according to their tenor, and all actions taken or purporting to have been taken under or in
pursuance of

such a management plan or notice, or purported management plan or notice, are or shall be taken to have
been effectively taken, notwithstanding any want of power or procedural defect in or in relation to the making
of the plan or giving of the notice, including that it may not have been laid before the Legislative Assembly in
pursuance of section 63 of the Interpretation Act.".

On the motion of Mr Palmer the following new clause was added to the Bill -

"41. PRESERVATION OF CERTAIN RIGHTS

Nothing in this Act shall be taken as affecting -

(a) any private right in relation to -

(i) fish or aquatic life; or

(ii) a fishery or fishery management area or other area of land or water affected by this Act; or

(b) any proprietary right in relation to land,

that existed immediately before the commencement of this section.".

suspended as would prevent the Northern Territory Tourist Commission Amendment Bill (No. 2) 1994 (Serial 34) passing all stages at this sitting.

24. NEW PARLIAMENT HOUSE - MOTION OF APPRECIATION:
The order of the day having been read for the resumption of the debate on the motion :

'Mr Speaker, on this historic inaugural sitting in the Northern Territory's new Parliament House I move that the following resolutions be agreed to:

1. That this Assembly extends a warm welcome to those Presiding Officers and representatives of other Parliaments who are present today;

2. That this Assembly expresses its appreciation to the Parliaments, organisations and individuals who have graciously presented gifts for
use and display in the new Parliament House. The list of these gifts is extensive. Recognising the addition of this building to the family
of Parliaments, the Presiding Officers of the Senate and the House of Representatives jointly gifted the Chair of the Speaker; the State
Parliaments donated a lectern and the many individual gifts include a Commemorative Medal marking the first sitting of the Commonwealth
Parliament in 1901. It was donated by long time Territorian, Miss Ellen Kettle.

3. Noting that this building now stands as a permanent display of the craft and construction skills of Territory workers and construction companies,
this Assembly extends its sincere appreciation to all who were involved in its planning and construction, including the architects, engineers and
designers; the project manager, contracting companies and their employees; artists and craftsmen; those who advised on all aspects of interior
design, furnishing and decoration; members of the former New Parliament House Site Committee, past and present members of the Sessional
Committee on the New Parliament House, officers of the Department of Transport and Works and parliamentary and other staff for their endeavours
in providing this most magnificent building for the people of the Northern Territory.

4. That this Assembly acknowledges the debt of gratitude owed by Territorians to former members of this Assembly and the former Legislative
Council and to Territory members of the Commonwealth Parliament who contributed to the constitutional development of the Northern Territory,
the creation of our first fully elected legislature in 1974, and the grant of the interim charter towards statehood with the commencement of
self-government in 1978.'
