1. MEETING:
      The Assembly met at 10am. The Speaker, the Honourable J. L. Aagaard, took the Chair.

3. MINISTERIAL REPORTS:
      HomeNorth Extra: The Minister for Housing (Mr McAdam) reported on the demand and take up of the government HomeNorth Extra housing scheme.
      Dr Lim responded.
      Mr Wood responded.
      Mr McAdam responded.

      Soccer Stadium, Progress Report: The Minister for Sport and Recreation (Ms Lawrie) reported on construction of the Soccer Stadium at Marrara and development of soccer in Central Australia.
      Mr Mills responded.
      Ms Lawrie responded.

      Prisoner Integrated Management System: The Minister for Justice and Attorney-General (Dr Toyne) reported on a proposed Prisoner Integrated Management System to manage offender records and case management processes.
      Ms Carney responded.

      Ministerial Reports noted, pursuant to Standing Orders.

4. JUSTICE LEGISLATION AMENDMENT (GROUP CRIMINAL ACTIVITIES) BILL 2006 (Serial 65):
      The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act to amend legislation to deal with group criminal activities.
      Bill read a first time.
      Dr Toyne moved - That the Bill be now read a second time.
      Debate ensued.
      Paper tabled: Dr Toyne laid on the Table the following Paper -
Explanatory Statement, Justice Legislation Amendment (Group Criminal Activities) Bill 2006 (Serial 65) (Paper 606).

      On the motion of the Member for Araluen (Ms Carney) debate was adjourned.
5. EVIDENCE AND OTHER LEGISLATION (WITNESS ASSISTANCE) AMENDMENT BILL 2006 (Serial 64):
      The Minister for Justice and Attorney-General (Dr Toyne), pursuant to notice, presented a Bill for an Act to amend the Evidence Act and other legislation relating to the assistance given to witnesses in legal proceedings.
      Bill read a first time.
      Dr Toyne moved - That the Bill be now read a second time.
      Debate ensued.

6. DARWIN WATERFRONT CORPORATION BILL 2006 (Serial 55):
      The Order of the Day having been read for the resumption of debate on the question - That the Bill be now read a second time -

      The Assembly resolved itself into Committee of the Whole for consideration of the Bill.

      On the motion of the Chief Minister (Ms Martin) the following amendment was agreed to, after debate.

      After subclause (2), insert -
          (2A) To avoid doubt, the Corporation's functions under subsection (1) include the maintenance of the quality of:

              (a) any enclosed body of sea water (whether treated or untreated) that is designed as a feature of the Precinct; and
              (b) the water in any water feature or recreational facility on land owned or managed by the Corporation in the Precinct.

      Clause 12, as amended, agreed to.
      Clauses 13 and 14, by leave, taken together and agreed to.
      Clause 15 read.
      On the motion of Ms Martin the following amendment was agreed to, after debate.

      In subclause (2), omit "and (5)" and insert ", (5), (6) and (7)".

      On the motion of Ms Martin the following further amendment was agreed to, after debate.

      Omit subclauses (5) and (6) and insert in their stead -
          (5) Land that would have been exempt from rates under section 58 of the Local Government Act is exempt from the rates mentioned in subsection (3).

          (6) However, common property in a registered plan is not exempt from the rates mentioned in subsection (3)(b).

          (7) The rates mentioned in subsection (3)(b) must be imposed on the following basis:
              (a) for common property in a registered plan – the rates mentioned in subsection (3)(b) that are imposed on the property for a year must not exceed 20% of sum of the rates mentioned in subsection (3)(a) that are imposed on all the units in the plan for that year;

              (b) for any other land – the rates mentioned in subsection (3)(b) that are imposed on the land for a year must not exceed 20% of the rates mentioned in subsection (3)(a) that are imposed on the land for that year.
          (8) The by-laws may make provision about the rates.

          (9) In this section:
              "common property" means common property as defined in the Unit Titles Act;

              "registered plan" means a units plan or building development plan registered under the Real Property (Unit Titles) Act;

              "unit" means a unit as defined in the Unit Titles Act.

      Clause 15, as amended, agreed to.
      Clause 16 read.
      On the motion of Ms Martin the following amendment was agreed to, after debate.
      At the end insert -
          (4) The regulations may provide for the maximum amount of the levy that may be imposed on a person for a year (including specifying how that amount must be worked out).

      Clause 16, as amended, agreed to.
      Remainder of the Bill, by leave, taken as a whole and agreed to.
      Bill to be reported with amendments.

7. CONSUMER AFFAIRS AND FAIR TRADING AMENDMENT BILL 2006 (Serial 58):
      The Order of the Day having been read for the resumption of debate on the question - That the Bill be now read a second time -

      Bill read a second time.
      Leave granted for a motion for the third reading of the Bill to be moved forthwith.
      On the motion of the Minster for Justice and Attorney-General (Dr Toyne) the Bill was read a third time and passed to be a proposed law.
8. MIDDLE YEARS OF SCHOOLING - MOTION TO NOTE STATEMENT:

      Visitors: The Speaker advised Members of the presence in the public galleries of visitors to the Assembly and participants in the Parliament House Public Tour Program of the Legislative Assembly.
      On behalf of all Members the Speaker extended a warm welcome to the visitors.


9. STATEMENT BY SPEAKER:
      The Speaker advised Members of the need to adhere to the behaviour constraints required by Standing Orders 61, 62 and 63 and reminded Members that over the past few days Members had been repeatedly reminded of their responsibilities.

12. VOLATILE SUBSTANCE MISUSE PREVENTION AND INTERVENTION PROGRAM, PROGRESS REPORT - MOTION TO NOTE STATEMENT:
      The Minister for Family and Community Services (Ms Lawrie) made a statement relating to implementation of the Northern Territory's volatile substance misuse prevention and intervention program.
      Ms Lawrie moved - That the Assembly take note of the Statement.
      Debate ensued.
      On the motion of the Treasurer (Mr Stirling) debate was adjourned.

13. COMPULSORY UNIFORMS POLICY - MINISTERIAL STATEMENT - MOTION TO NOTE STATEMENT:
      The Minister for Employment, Education and Training (Mr Stirling) made a statement relating to the implementation of school uniforms for students to Year 9.
      Mr Stirling moved - That the Assembly take note of the Statement.
      Debate ensued.
      On the motion of the Leader of Government Business (Mr Henderson) debate was adjourned.
