1. The Department of the Chief Minister continues to work with the Darwin Port Corporation and FreightLink to directly promote Darwin as an alternative trade route for Australia. Promotional work undertaken in 2005 included participation in Port Conferences held in Manila, Surabaya and Bangkok, as well as several direct marketing visits targeting regional Asian shipping lines, global logistics service providers and major importers and exporters.
2. We continue to work with all potential import/export clients and more. The Territory government’s Global Freight Connect Conference held at the end of October 2005 attracted a formidable list of key executives representing chemical, retail, shipping line, freight forwarding and Chamber of Commerce personnel. One outcome from this conference has been the successful negotiations to ship mining chemical products through the port of Darwin.

2. It is my understanding that increased funding for the government’s domestic violence program was rejected and that a review into the program and its funding is to be conducted. Is that true?
3. When will this review be undertaken?
ANSWER
1. Yes, the resources allocated to the government’s Domestic and Family Violence Strategy have increased in 2005-06, through five joint Australian and NT government bilateral projects. Funding totals $4.26m, with the Australian government contribution totalling $1.83m. These additional resources are consistent with government’s comprehensive domestic violence strategy.
2. While funding was not initially provided for a program working with offenders, this initiative has now been funded through a bilateral agreement with the Australian government. The governments’ Domestic and Family Violence Strategies were launched in late 2002. At that time, the government foreshadowed ongoing evaluation and improvement which has already commenced with the establishment of a new advisory council.
3. An independent evaluation of the strategies is currently being conducted by Charles Darwin University, with findings due in 2006.

ANSWER
1. Monash University were paid as consultants for work undertaken in 2004-05 by the Office Women’s Policy.
2. Monash University was engaged to develop a set of gendered social indicators responsive to the Northern Territory situation. The project was to explore designing a set of indicators that would allow for the measurement of progress in women’s social, economic and cultural wellbeing in the NT.
3. A certificate of exemption was approved by the Chief Minister on 1 November 2003 and endorsed by the Procurement Review Board on 13 November 2003 on the basis that there was no local company/entity with the required expertise.
4. The consultancy was managed through the Contract and Procurement Services Branch (CAPS) of the Department of Corporate and Information Services. The contract is mandated and was awarded 12 January 2004.

7. Royal Darwin Hospital (RDH) has a number of strategies to minimise and manage poor patient-related behaviour. These range from zero tolerance signage throughout the hospital campus, aggression management in-services for staff, aggression management policy and ‘action plans’, looking at the ways we do business, and eliminating work methods/issues that may help fuel aggression. The method of reporting abusive behaviour has been improved to encourage and make it easier for busy staff. This data collection methodology has increased the statistics, as stated in the ‘Important Notes’ comment below.
8. There are no reported incidents of aggression in single nurse stations.

Funding to health research has been cut in this budget by $300 000. In your speech about the budget last year, you said that the Menzies School of Health Research, CRC for Aboriginal Health and the Health Gains Unit made ‘a valuable contribution to the evidence base of our health policies and services –

ANSWER
The Menzies School of Health Research, CRC for Aboriginal Health and the Health Gains Unit continue to provide the most relevant local sources of new knowledge for health policy and practice in the NT.
$300 000 was the variation between the 2004-05 estimated expenditure and the 2005-06 published budget for the Health Research output.
The variation between the actual expenses for 2004-05 of $4.579m and the published budget for 2005-06 of $4.380m is $199 000.
This variation is mainly due to the reallocation of $276 000 of depreciation costs that were incorrectly attributed to this output in 2004-05.
In 2004-05, Menzies School of Health Research was paid a grant payment of $3.44m. In 2005-06, the Menzies School of Health Research grant will increase to $3.528m, reflecting the 2.5% increase in indexation. MSHR also administers the Father Frank Flynn Fellowship of $87 000.
The Cooperative Research Centre for Aboriginal Health was paid $150 000 in 2004-05, and will receive the same amount in 2005-06.
Health Gains Unit expenditure for 2004-05 was $1.35m against a budget of $1.39m. The 2005-06 budget has increased to $1.4m.

1. A Canon power shot A75 digital camera, with an estimated value of $450 was stolen. Four mobile phones with a total estimated value of $600 were lost or stolen.
204. Disability Services – Taxi Vouchers

I have a constituent who is disabled with arthritis. She cannot drive but owns a car so that her friends/family can drive her when they are available. She would like taxi vouchers but has been told that as she owns a car she cannot have them. She is often stranded.
What can be done to provide this constituent with taxi vouchers as this current situation is not equitable?
ANSWER
The Northern Territory Taxi Subsidy Scheme (NTTSS) provides assistance in the form of taxi vouchers to people who have disabilities that make them not able to use public transport to participate in day-to-day community activities.
People who have chronic conditions such as arthritis that hinders them driving their cars intermittently, can apply for one-off emergency assistance from the scheme.
People who own a car and have a current Northern Territory Driver’s Licence are not eligible for subsidies under the scheme.
225. Daly River Region Community Reference Group

Your government established the Daly River Region Community Reference Group in 2003. How many people were on this group, who were they?
The final report from the Daly River Region Community Reference Group was delivered to Cabinet in December 2004, and to date this report has not been tabled in parliament:

ANSWER
The Daly River Community Reference Group (CRG) comprised 20 representatives from a range of backgrounds. Membership was as per Attachment A.
1. The report of the CRG raised a large number of issues, which required careful consideration prior to Government decisions and the release of the report. The report strongly stated that the knowledge base to inform decision-making for the Daly Region is incomplete, particularly in relation to the aquatic ecosystems of the Daly, the relationship between groundwater aquifers and river flow, and the values Aboriginal people attach to land and water. This prevented the CRG from completing the tasks it was given by the Chief Minister and the then Minister for Lands and Planning. These deficiencies in data and information will be remedied to give the community confidence in future development of the Daly Region.
2. The report was made available to the public via the then Department of Infrastructure, Planning and Environment website in June 2005.
3. The total cost of the CRG process, and related work with the Aboriginal Reference Group, was $375 498.
(ii) committing to the establishment of an adaptive management framework for future development of the Daly Region;
(iii) establishing the Daly River Management Advisory Committee; and
(iv) a commitment of $3.5m over four years to fund community engagement processes and the acquisition of further knowledge as identified by the CRG report.
Members of the community involved in future management of the catchment will not be doing the same job as the CRG. The proposed Daly River Management Advisory Committee will oversight implementation of the CRG’s key recommendations, build new monitoring systems, and establish new processes for open decision-making and review. They will not only ensure the health of the river and its surrounds, but promote well-considered development and conservation goals that take account of all of the region’s values and the aspirations of all its people.

ANSWER
1. Aboriginal Land Rights (Northern Territory) Act 1976: There are currently no ALRA matters the subject of court proceedings.
- Native Title Act 1993: As at 10 October 2005 there were a total of 202 active claims under the Native Title Act in the Northern Territory. This figure comprises 197 claimant applications for a determination of native title and five compensation applications. Attached is a list of these native title applications as provided by the Federal Court of Australia.
- By way of background, applications under the Aboriginal Land Rights (Northern Territory) Act 1976 (ALRA) are lodged with the Aboriginal Land Commissioner. The Aboriginal Land Commissioner must ascertain whether the applicants or any other Aboriginal people are the traditional owners of the land claimed. The commissioner then reports his findings to the relevant federal minister. Although the Aboriginal Land Commissioner must be a judge of the Federal Court of Australia or of the Supreme Court of the Northern Territory, and the parties are generally represented by lawyers, the process under ALRA is administrative, not judicial.
According to the Aboriginal Land Commissioner's Report for the year ended 30 June 2005 there were:

- Unlike the process with ALRA claims, all native title claims are filed in the Federal Court of Australia. The proceedings are, therefore, adversarial in nature as opposed to the ALRA inquisitorial proceeding.
- Native title/related matters which have been heard (fully or in part) or are set down to be heard or are subject to an appeal or special leave applications are:
Full Federal Court:
- 1. Blue Mud Bay and associated proceedings: This claim was filed on 27 November 2002 on behalf of 13 clan groups to an area over Grindall and Myaoola Bays and Aboriginal freehold vested in the Arnhem Land Aboriginal Land Trust in Blue Mud Bay in Arnhem Land. The court has handed down its determination, and the matter is now subject to appeal and due to be heard in the Federal Court in August 2006.
- High Court of Australia:
- 2. Davenport/Murchison: A special leave application to the High Court of Australia was filed by the Territory on 26 August 2005. The special leave application is in respect of three aspects of the Full Federal Court's decision, namely: (1) the existence of a native title right to ‘live on’ the land which may encompass a right to live permanently, establish permanent communities and erect permanent structures; (2) the application of section 47B of the Native Title Act which requires prior extinguishment to be disregarded in certain circumstances; and (3) the conclusion that the claimants ‘occupied’ the relevant area within the meaning of the Native Title Act at the time of the application.

- A number of shipping line operators have demonstrated an interest in commencing a shipping service trading between Surabaya and Darwin. Commercial-in-confidence negotiations are proceeding between various private sector players (including regional shipping lines) about the establishment of such a service during 2006. Paper products, plastics, glassware and automotive manufacturing parts are being targeted for imports and, for exports, the focus is on base metals, wheat, fodder and food products.

1. In February 2005, the Northern Territory government released its Growing our Trade Route strategy.
- This whole-of-government strategy identifies eight focal opportunities for growing the new trade route and lists associated strategic priorities/actions that will be pursued during 2005-06 to realise these opportunities.
Key opportunity areas include: securing new international shipping links; increasing supply base activities for the offshore gas industry; securing new bulk mineral exports; further development of the Darwin Business Park; and developing stronger regional freight hubs in Katherine and Tennant Creek.
The Department of the Chief Minister continues to focus on the Growing our Trade Route strategy. A new international shipping link between Indonesia and Darwin is still under investigation and significant inbound volumes to commit a service have been identified. Opportunities for export on the return shipping sector northbound is the challenge, and the focus on bulk minerals continues as the priority.
- Hai Win Shipping have established a monthly direct shipping service between Shanghai and Darwin.
- In September 2005, the first trial of a Surabaya to Darwin service was completed by Swire Shipping and Toll Holdings. This trial involved the discharge of 54 containers of paper product from Surabaya at East Arm port. These containers were subsequently unpacked at the Toll facility in the Darwin Business Park and then re-packed into empty domestic containers for distribution across Australia by the road and rail networks. Commercial-in-confidence negotiations are continuing with various private sector players with a view to establishing a regular Surabaya-Darwin shipping service during 2006.
Bulk minerals trade outcomes:
New bulk handling facilities are currently under construction at East Arm and are expected to be operational by April 2006. These facilities will service an initial 650 000 tonnes per annum of bulk manganese exports from the Bootu Creek development (near Tennant Creek) to China. Potentially, they can also service over one million tonnes of iron ore exports from the Frances Creek deposit – which Territory Iron are currently looking to develop and have operational by the end of 2006/early 2007.

Funding totals $4.26m, with the Australian government contribution totalling $1.83m. These additional resources are consistent with government’s comprehensive domestic violence strategy.
2. While funding was not initially provided for a program working with offenders, this initiative has now been funded through a bilateral agreement with the Australian government. The governments’ Domestic and Family Violence Strategies were launched in late 2002. At that time, the government foreshadowed ongoing evaluation and improvement which has already commenced with the establishment of a new advisory council.
3. An independent evaluation of the strategies is currently being conducted by Charles Darwin University, with findings due in 2006.

1. Monash University were paid as consultants for work undertaken in 2004-05 by the Office Women’s Policy.
2. Monash University was engaged to develop a set of gendered social indicators responsive to the Northern Territory situation. The project was to explore designing a set of indicators that would allow for the measurement of progress in women’s social, economic and cultural wellbeing in the NT.
3. A certificate of exemption was approved by the Chief Minister on 1 November 2003 and endorsed by the Procurement Review Board on 13 November 2003 on the basis that there was no local company/entity with the required expertise.
4. The consultancy was managed through the Contract and Procurement Services Branch (CAPS) of the Department of Corporate and Information Services. The contract is mandated and was awarded 12 January 2004.

7. Royal Darwin Hospital (RDH) has a number of strategies to minimise and manage poor patient-related behaviour. These range from zero tolerance signage throughout the hospital campus, aggression management in-services for staff, aggression management policy and ‘action plans’, looking at the ways we do business, and eliminating work methods/issues that may help fuel aggression. The method of reporting abusive behaviour has been improved to encourage and make it easier for busy staff. This data collection methodology has increased the statistics, as stated in the ‘Important Notes’ comment below.
- Alice Springs Hospital and, indeed, the other Territory hospitals, have undertaken similar management measures to those applying at RDH. This has led to a similar increase in reporting.
8. There are no reported incidents of aggression in single nurse stations.
IMPORTANT NOTE:
- In 2004-05, enhancements were made to the methodology of gathering aggression statistics in the workplace. This was achieved with a simplified tick/flick sheet in the ward/clinic. Due to this, a better indication of aggression-related occurrences has been able to be gained for incidents occurring in specific areas of RDH and Katherine.
This should not necessarily be construed as an increase in the occurrence of aggression-related incidents, but as an increase in realization of those occurrences. It is only over time, using the same methodology, that any conclusion can be drawn.

Funding to health research has been cut in this budget by $300 000. In your speech about the budget last year, you said that the Menzies School of Health Research, CRC for Aboriginal Health and the Health Gains Unit made ‘a valuable contribution to the evidence base of our health policies and services –

ANSWER
The Menzies School of Health Research, CRC for Aboriginal Health and the Health Gains Unit continue to provide the most relevant local sources of new knowledge for health policy and practice in the NT.
$300 000 was the variation between the 2004-05 estimated expenditure and the 2005-06 published budget for the Health Research output.
The variation between the actual expenses for 2004-05 of $4.579m and the published budget for 2005-06 of $4.380m is $199 000.
This variation is mainly due to the reallocation of $276 000 of depreciation costs that were incorrectly attributed to this output in 2004-05.
In 2004-05, Menzies School of Health Research was paid a grant payment of $3.44m. In 2005-06, the Menzies School of Health Research grant will increase to $3.528m, reflecting the 2.5% increase in indexation. MSHR also administers the Father Frank Flynn Fellowship of $87 000.
The Cooperative Research Centre for Aboriginal Health was paid $150 000 in 2004-05, and will receive the same amount in 2005-06.
Health Gains Unit expenditure for 2004-05 was $1.35m against a budget of $1.39m. The 2005-06 budget has increased to $1.4m.

- DHCS has a significant number of assets with an acquisition value of $5000 or greater recorded on its Asset Register. The department’s Asset Register and Register of Losses is maintained by DCIS as a whole-of-government service. No assets on this register were recorded as lost or stolen in 2004-05.
204. Disability Services – Taxi Vouchers
Ms CARNEY to MINISTER for FAMILY and COMMUNITY SERVICES
I have a constituent who is disabled with arthritis. She cannot drive but owns a car so that her friends/family can drive her when they are available. She would like taxi vouchers but has been told that as she owns a car she cannot have them. She is often stranded.
What can be done to provide this constituent with taxi vouchers as this current situation is not equitable?
ANSWER
The Northern Territory Taxi Subsidy Scheme (NTTSS) provides assistance in the form of taxi vouchers to people who have disabilities that make them not able to use public transport to participate in day-to-day community activities.
People who have chronic conditions such as arthritis that hinders them driving their cars intermittently, can apply for one-off emergency assistance from the scheme.
People who own a car and have a current Northern Territory Driver’s Licence are not eligible for subsidies under the scheme.
225. Daly River Region Community Reference Group

Your government established the Daly River Region Community Reference Group in 2003. How many people were on this group, who were they?
The final report from the Daly River Region Community Reference Group was delivered to Cabinet in December 2004, and to date this report has not been tabled in parliament:

ANSWER
The Daly River Community Reference Group (CRG) comprised 20 representatives from a range of backgrounds. Membership was as per Attachment A.
1. The report of the CRG raised a large number of issues, which required careful consideration prior to Government decisions and the release of the report. The report strongly stated that the knowledge base to inform decision-making for the Daly Region is incomplete, particularly in relation to the aquatic ecosystems of the Daly, the relationship between groundwater aquifers and river flow, and the values Aboriginal people attach to land and water. This prevented the CRG from completing the tasks it was given by the Chief Minister and the then Minister for Lands and Planning. These deficiencies in data and information will be remedied to give the community confidence in future development of the Daly Region.
2. The report was made available to the public via the then Department of Infrastructure, Planning and Environment website in June 2005.
3. The total cost of the CRG process, and related work with the Aboriginal Reference Group, was $375 498.
(ii) committing to the establishment of an adaptive management framework for future development of the Daly Region;
(iii) establishing the Daly River Management Advisory Committee; and
(iv) a commitment of $3.5m over four years to fund community engagement processes and the acquisition of further knowledge as identified by the CRG report.
Members of the community involved in future management of the catchment will not be doing the same job as the CRG. The proposed Daly River Management Advisory Committee will oversight implementation of the CRG’s key recommendations, build new monitoring systems, and establish new processes for open decision-making and review. They will not only ensure the health of the river and its surrounds, but promote well-considered development and conservation goals that take account of all of the region’s values and the aspirations of all its people.
